AOS Q on I-765 - New Employment or Renewal?

Hi,

When my then fiance came to America he had his passport stamped at JFK for work authorization (he never technically sent in paperwork), instead they provided this stamp on his passport when he entered the U.S. Now that we are married and he is applying for the Adjustment of Status, we are working on I-765, and my question is on two things, first it says I am applying for - is it Permission to accept employment or Renewal of my permission?? As tehcnically it is a renewal as his Employment Authorization stamp ended on February 19th, then on question 11 - it says have you ever before applied for employment authorization from USCIS - we never applied technically so should we check no?

They actually mean EAD, so you would be applying for permission to accept employment. The renewal would be for those who already got the EAD and it expired.

*3/5/09 Green Card received in the mail!!!
