Since my wife wasn't working when I came to the country, her grandmother was the primary on the affidavit of support.

We are ready to send in the forms for AOS application but her grandmother is, sadly, terminally ill with cancer and I do not know if she will will be alive long enough for everything to process through. I'm hoping she'll make the 45 days until my employment document is issued, but the odds of that happening are decreasing by the day.

So what do I have to do if she dies while this application is pending?

I am working right now (was lucky enough to get a temp work auth at point of entry and find a job before it expired) but I don't think the income would be considered enough for support. My wife is doing daycare at our house but it's not bringing in a lot of money either.

Embassy: Montreal

NOA1: 4-24-2007

NOA2: 8-15-2007

Recieved Packet 3: 9-15-2007

Returned Packet 3: 1-29-2008

Montreal Recieved: 2-04-2008

Interview date: 3-27-2008 (APPROVED!!!)

Visa in hand: 4-01-2008 (and it wasn't an APRIL FOOLS JOKE!)

Date of US entry: 4-12-2008

Date of wedding: 5-24-2008

AOS, EAD & AP Filed: 10-02-2009

AOS, EAD & AP NOA1: 10-19-2009

The petitioner is always the primary sponsor. For AOS, it's the same except you'll have a "joint sponsor". Has Grandma filled out the I-864 and signed it yet?

Yes, all the paperwork is signed and ready to be filed. Do I just send it in anyway?
