I have not received a NOA for my I-485, what should I do?

Dear Friends:

I married on November 8th last year and filed the I-130 and I-485 and received a NOA for the I-130 on December 2nd and a Rejection Notice for the I-485 basically because we did not know we should send the I-130 first and then once we got the NOA for it then we could send the I-485. And so we sent the I-485 again at the very next day December 3th via Express US MAIL at the same address and we have not heard from them and is February, not even a NOA.Nothing.

Should I be worry? Is there something I can do? This situation is in my mind all the time. I even blame my husband because he did not send it via courier like I ask, does it really matter?

I would appreciate your comments,

FORM DS-3032 : Mailed via regular US Mail to NVC : 2009-02-27

I-485 was rejected because of an invalid part 2 applycation type other basis of eligibility.

I-485 Re-Sent:2008-12-19(Thaks to u guys, I could filled the right answer :) )

I-485 : Check cashed on 2009-01-07

Sorry for your situation. I sent my AOS package via USPS Express mail, so I do not think it matter if you use USPS or courier. Did you check the tracking number and confirme whether your package was delivered?

Also, did the check or money order for I-485 has already cashed? If the check/money order was already cashed, it might mean NOA for I-485 was sent but lost. If the check/money order has not cashed yet, it is possible I-485 was lost or somebody is still holding the package without opening it.

When you resent I-485, did you attach I-130's NOA or at least wrote down the case number of I-130 in your cover letter to I-485 so that USCIS can know your I-130 and I-485 are for the same matter?

Hope you can receive NOA soon. But if not, it might be better to call 800 number or make info pass appointment and find out what is going on.

The I-130 and the I-485 can be sent together, they just have to have a check for each application and they have to be in the same envelope and they are sent to the Chicago Lockbox.

But that is in the past. You needed to include a copy of the NOA for the I-130 with the AOS application. It may take a while for you to get the NOA as they will need to check the status of your I-130.

I am sure you will get something real soon.

Thanks for your answer, I just check with my husband and yes USCIS cashed the check pretty much a few days after receiving the package, so its been like 45 days is that a reasonable amount of time? We will make the call on monday, thank you.

That's a good news. :thumbs: At least you now know package was delivered and USCIS accepted your application (I think USCIS will not cash the check if they will not accept the application). 45 days seems pretty long but you should receive NOA soon. Hope you can find out anything good when you call Monday.

Also, I encourage you to read and/or post to a thread for December 2008 AOS filers where many December filers are exchanging the progress of each AOS application (It is under "Adjustment of Status Case Filing and Progress Reports" forum, which is a subforum for "Adjustment of Status (Green Card) from Family Based Visas") --also Here is the direct link. Most of December 2008 filers seem finished biometric, but some are still waiting to receive biometric appointment letter.
