ARE YOU SITTING DOWN>>>

AFTER 21 Months I-360 Approved !

Feelings -

1. Relief for the moment.

2. Tired - Mentally and physically

3. Anger - USCIS added to the overall frustration by changing rules on me since filing adding to the time to be approved.

Now I can apply for work permit. Not permitted to file when I first applied 21 months ago.

I'll have many on my side to get this process for abused people streamlined in the future for others.

I-360 Time Line

May 2008 - 1st attorney filed I-360

August 2008 - 2nd attorney re-filed I-360 after no response of file from first

2008 PFD - 2 received extensions

2009 PFD - 3 extensions

November 2009 - RFE received and sent back first week.

November 2009 - 2nd week USCIS letter stating 60 days to make decision.

January - 2010 - received 60 day extension

February - 2010- APPROVED I-360

I-360 VAWA:

November 1 2008 filed.

November 21 2008 NOA1

November 25 2008 RFE #1 received [good faith + good moral character].

January 7 2009 RFE #1 sent back.

June 9 2009 received a letter "Response to RFE #1 received on JANUARY 13, and case processing has resumed"

August 17 2009 RFE #2 [good faith].

October 27 2009 RFE #2 sent out.

October 28 2009 Response to RFE #2 received, and case processing has resumed

October 29 2009 touched

December 30 2009 touched

December 31 2009 touched

February 8, 2010, APPROVED.

September 4, 2010 touched.

March 18 2010 I-485 filed to VSC with a fee waiver.

So i guess divorce does not have to be final at the time of interview, correct?

Congrats on your approval, and your divorce does not have to be final before you can move to the next step, just be prepared to answer why you did not have a divorce, sometimes they ask, sometimes they don't. But you do not have to have a divorce to file I-485 good luck on your final step.

does my divorce have to be final in order to proceed to the next steps, which is filing i485 and so on?

Hi there, no, you should go ahead and file the I-485. The sooner you do it, the quicker you'll get your green card. I'm so happy for you, congratulations.

Thanks to everybody for congratulations and support :)

I'm going to apply for fee waiver request for I-485.

The poverty guideline is $10830 a year, which is $905.5 a month.

So my question is, if i have income more than that, does it mean that i'm automatically not eligible for a fee waiver?

Hi guys my vawa was approved in august 14 /2009. I did applied i 360, i485 together at the vermont center. In january i received a denial letter for my i 485 they claimed that i did not attend biometric appointment hence they declared my case abandoned. the truth is i did not receive any biometric notice till now. So my question is which is the fastest way to get my case back on track is it appealing or refilling a fresh a new i 485 any help will be appreciated. I have 30 days to appeal

Congratulations Lostin and everyone who's got an approval. I'm having my AOS interview on Thursday. I'm very excited.

hello everyone.im now getting all the evidences for my VAWA case.im in removal proceedings.i have a 9 months old baby.i left the house and spent 3 weeks in emergency shelter for domestic violence together w the baby.i am still married to USC ,but already applied for divorce.we were married for 4 years.i dont know what my chances are.here is what i have to prove the abuse.

no police report,cause i just left the house and went to the shelter 150 miles away from the city i lived + i was really scared that i wont be able to prove to police, but he would tell the social services to take the baby,since by myself i cant afford everything he needs

so what i have: letter from the shelter

letter from my case manager that she aware of the situation and trying to help me

therapist letter w phychological evaluation

records from the emergency room that i was pushed by my husband and fell down the stairs,and my xray of the head to determine

injuries( nothing serious was found)

social worker i was seeking help in a shelter,letter from her

another doctor evaluation,the one who reffered me to the emergency room,saying that due to the domestic violence i had health problems

letter from the child protective services that my husband is not allowed to contact the baby for 30 days (shelter informed them)

councelor letter that im attending domestic violence support group

witness statement( 2 of them)

my 15 pages statement

i found that im pregnant when i alredy left my husband,but i got a miscarriage

( so letter from the doctor stating the miscarriage)

PLUS MY BABY IS SICK,HE HAS SOME CONGENITAL ANOMALIES,AND TREATMENT HE IS GETTING IN US, WONT BE AFFORDABLE BACK HOME,THEY JUST DONT DO IT,MY LAWYER IS TRYING TO PROVE THE HARDSHIP.

PLZ ,WHAT DO U THINK,WHAT ARE MY CHANCES
