You should be alright and you should be expecting a decision by January/February ending. You and EWTN2009 been in this case for too long. I know how frustrated you are right now. I can't even be patient if its me. But your attorney are really aggressive on your case right ? Cause you need a real professional lawyer with this long timeline. 60 days is up next week. The law states within 60 days a response must be given.

FYI - the 485 and 765 were returned last year because the USCIS stated they must be filed with the I360 ONLY since the filing took place in 2008. What a bunch of BS.

I-360 Time Line

May 2008 - 1st attorney filed I-360

August 2008 - 2nd attorney re-filed I-360 after no response of file from first

2008 PFD - 2 received extensions

2009 PFD - 3 extensions

November 2009 - RFE received and sent back first week.

November 2009 - 2nd week USCIS letter stating 60 days to make decision.

January - 2010 - received 60 day extension

February - 2010- APPROVED I-360

That is BS for real. You can file I-360, I-485 and I-765 Concurrently if you want or if your spouse or ex-spouse is a United States Citizen or you can filed I-485 and I-765 together concurrently later if your spouse or ex-spouse is a US Citizen as well. You can't file I-485 and I-765 only if you are in removal proceedings because Immigration judge has jurisdiction over your I-485 case not USCIS. Your lawyer should call them and inquire why they returned your I-485 and I-765 if its properly filed. I just sent mine Dec 17, 2009 and they received it. Am surprised why they returned yours. Maybe other guys in this forum can shed more light on this for us if they are familiar with this situation.

UKRUSA did try to send any letter to congressman in your state

Hi Victoryismine, i filed all my forms together, I765, I360 and I485. My spouse is a citizen to begin with and so far, i got a email update saying they sent me the work authorization card. Good luck and best wishes to you guys!!!

The information given was/ is the "rules" changed after filing in 08 to file concurrently. Verified via congressman's office conference call with USCIS. What does it matter after the fact I have no idea. USCIS says it must be done with the original filing which the first attorney screwed up which delayed filings by the 2nd attorney.

It all comes down to the I-360 filed and the RFE info is so clear cut this extremely slow process is in itself abuse in every possible fashion by the USCIS. The "up to 60 days to review" process should not be used as tactic to delay and damage peoples lives further by USCIS. These people should be held accountable. Two years with no work, passport, travel, or ability to do anything but wait. Thanks God for those who have helped.

I-360 Time Line

May 2008 - 1st attorney filed I-360

August 2008 - 2nd attorney re-filed I-360 after no response of file from first

Hello ashleyblack, Yes I did called USCIS and press 3 because i didn't have the receipt number. The customer service ask me that has it take up to 30 days since i filed and I said yes, the he route me to the immigration officer who then ask for my informations to verify if am the real petitioner. Then immigration officer pulled up my information and told me that they received my applications and the receipt notice has been sent out to my attorney on record. She said it might take some days to reach my attorney. But she didn't give it to me on the phone due to the sensitivity of my case I-360. I hope I answered your question. Try that and let me know whats up.

@UKRUSA I know what you mean..sometimes Prima Facie determination is just to waste peoples time but it also serves as a proof that your case is in process and pending with them. Thats why you get relieved after approval.

Ohh ok, i did called them this morning, they told me as what they told you too and that I need to wait 30 days for the receipt notice of I-765 and I-485.

I dont have attorney so.It should be got it few more weeks i guess... wait .. wait.. this is all what we do to wait for them..

what documents are you taking...apart from the IDs,EAD..any bank statements? anything else?
