Hi,

I hope to help clear up for everyone on what needs to be submitted at VFS for CR-1 and K-3 filers.

Here is what I understand needs to be submitted for both:

1. Copy of Appointment letter

2. Courier Fee of 394 rupees

3. Copy of Passport biographic page

4. 2 Photographs of beneficiary

5. Medical Report

Here is what I understand needs to be submitted for CR-1 that will be sent by NVC in the CR-1 case file:

1. DS-230 Parts 1 and II, II unsigned

2. Birth Certificate original

3. Marriage Certificate original

4. Police Reports- Passport Office and Local Police- Originals of Both

5. Affidavit of Support- I-864 Form

6. Tax return(s)

7. Pay stubs of 2008 (if applicable)

8. Job Letter- Original (if applicable)

Here is what I understand needs to be submitted for K-3 in addition to the above with the exception of DS-230 and the I-864

1. DS-156

2. Affidavit of Support- I-134 Form

On the day of the interview, I understand beneficiary would need the following:

1. Original Passport

2. Original Appointment Letter

3. Proof of Relationship

4. VFS Receipt of everything that's been submitted

5. Photocopies of everything that's been submitted

6. In case of K-3, the K-3 application fee of $131

I don't have much knowledge about k-3 but for CR-1 you don't have to submit your tax returns.

1. DS-230 Parts 1 and II, II unsigned

2. Birth Certificate original (could be photocopy, given you submitted the original at NVC)

3. Marriage Certificate original (could be photocopy, given you submitted the original at NVC)

4. Police Reports- Passport Office and Local Police- Originals of Both (could be photocopy, given you submitted the original at NVC)

5. Affidavit of Support- I-864 Form -- Don't need

6. Tax return(s)--don't need, take it for interview day though

7. Pay stubs of 2008 (if applicable)--don't need, take it for interview day though

8. Job Letter- Original (if applicable)--don't need, take it for interview day though

Timeline

One thing to realize about VFS is that they are simply a 'facilitating' agency for the US Consulate. In other words, you need to pay them the fees for the courier services, but the rest is simply is a good practice, so that you are prepared for interview date. The documents, if cannot be submitted to VFS, can be taken to the interview. Essentially, VFS will forward everything you gave them to the US Consulate with the expection of the 394 Rupees.

I called VFS yesterday and learned that my wife doesn't need to go there in person. One of our family friends who lives in Mumbai will pay the fees and submit the photocopy of the passport and the NVC letter that they have requested.

Great to hear from both of you!

CJ was it a person at VFS who confirmed that we don't have to submit anything other than the courier fees to them?

I called VFS and heard a conflicting answer, that we must submit documents. Just trying to get a definitive answer.

I see on the checklist letter that accompanied my wifes Packet 4 (for K-3) that if we wish, we may submit our documents to the Consulate on the day of the interview but that we must pay the courier charges at a VFS office. So I hope that this is right.

I would prefer not to submit anything other than the courier fee as we're looking to be issued a CR-1 on our K-3 date.

I think your situation is a bit tricky given the flip. You are better off submitting the copies of the documents as trinket mentioned. You have to make VFS believe that you are going for the K3 interview, in reality though, you will be issued the CR1. I am going to India on 2/15, so e-mail me if your wife has any questions. My wife's interview is on the 25th.

Yes CJ, I agree with you that the situation is different. I feel like I'm trying to make history or something :-)

I am starting to believe that regardless we should be ready with some documents to submit, even if they're just copies and not the originals.

I believe you're looking to submit documents on Feb 16? Just making sure that you know VFS is closed on that day.

Also, I have decided to come to India as well. I should get there on the 25th. So I look forward to hearing good news after I land! :-)

CJ and Sanket - Wishing you happy and a successful journey in advance.

Sanket - I believe that it would be a better option to submit all documents listed in your K-3 Packet 4 to VFS even though you want a CR1 visa. For CR1 visa only, I believe that one does not need to submit photocopy of documents submitted to NVC - courier fee, passport photos etc would suffice.

Also, you have an option of taking the medical report personally to the interview. I have read in the forums that many prefer to take this report personally (don't know exactly why). We plan to do the same.

It looks like I need to fill out DS-156, and have a demand draft ready for the K-3 fee to be paid on the interview day. Is there anything else unique to K-3 that needs to be submitted?

I will call VFS to reconfirm what needs to be submitted and whether or not we can go without submitting documents to them.

Let me clarify. I am planning for CR-1. However I had the idea that if the Consulate is not aware that the CR-1 file is on their premises by the interview date, they may ask to see if she has the $131 demand draft before letting her into the Consulate. So if the Consulate is not aware of the CR-1 on the interview day then I she would have the $131 so that she can get inside. Once she is inside, and she speaks to the officer about the CR-1 being there, then the payment of the $131 would not be necessary.

I am hoping and expecting that the CR-1 file gets there before hand, so that the switch can be administered before the interview date and having this $131 demand draft beforehand is not necessary.

Please let me know if my understanding about the K-3 demand draft is not correct.

I see. As per my understanding I dont think they will ask for demand draft at the door to let her go inside consulate, they will ask for it at the window payment so by then you can ask them about the cr1 file. Others who went through mumbai consulate please confirm if this is what they do.

The demand draft definitely does not need to be submitted to VFS beforehand.

What waithatter says about providing the demand draft at the window makes sense. I will go by that pretense.

We did K3 and were not required to submit the demand draft to VFS, nor was it needed to enter the consulate.

They collected it after the fingerprinting process inside the consulate.

Oh this is better. I was under the impression that the demand draft needs to be submitted to VFS beforehand.

Anyone who has completed K3, can you please let us know at what point your demand draft was verified/collected?
