We were on our way to a blissful life. The ex of my fiancée was content to let their son come to the US with her. Now we are down to the last couple of months (so unbelievable we are even so close) and he has changed his mind. Now my fiancée is left with a choice to leave her son, or stay with her son. I already know that answer - motherhood trumps fiance. She has 100% custody and he has rights to visitation. I know in the US, you cannot even take the children across state lines without the Ex's approval. We are in shock. We are really not sure what to do next. I welcome your advice.

Keep mother, father and child in same city/country, until child is 18.

Not sure why you or your fiancee thought it was okay to separate a child from his father. Children, especially boys, need their fathers. Glad to see the father feels the same way.

I understand what you are saying. I have put myself in his shoes. You missed what I said earlier... he agreed to allow their son to move with her. We weren't forcing him, we weren't legally attacking him. We were intending to pay for travel to and from Brazil so that the son could spend lengthy time with the father (on the order of months). We had no intention of excluding him.

This is a hard situation, the father will always be a part of their childs life, well unless if the father is a dead beat and neglects their kids then it's totally a court type of deal.

In your case you will have to speak to the fahter, that's the most logical and reasonable thing to do. Explain to him that you are merely givng his child a better future and better opportunities. But there are no guarantees in this, a father is a father, put yourself in his shoes.

A totally hard situtation. I wish you all the best and Godspeed.

The border doesn't always enforce it but there is a requirement to travel with proof that the non-custodial parent has granted permission to travel out of the country. I've been asked for this proof many, many times going into Canada.

If the father has a legitimate relationship with the child, he likely won't be bought off. But if he is only doing this for control, maybe he can be. I'd go the $$ route first, myself.
