hi everybody,

i been here in US for almost 3 months already w/ K3 visa,we're confused if how we will start to apply for adjustment of status,what are the steps,how long it takes to approve and what are the forms we need to fill up.

So if anybody had done this already and wanna share their experience,we will appreciate it much..Thanks

What you want to do is click on the word "Guides" at the top of any page here. After studying the AOS from a family visa "Guide" this is the forum for remaining questions.

Some on K-3 wait until close to their 2 year wedding anniversary to file for AOS, if the AOS is approved AFTER to years of marriage the resulting green-card will be a 10 year unconditional card.

Keep in mind you need to file AOS less than 1 year after your visa medical, or you will be stuck having to get another full medical (I-693) for AOS.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

It's up to you.

You can file I-485+I-765 for EAD Now for $1010, more than likely this will result in a 2 year CR-Green-card that will later need removal of conditions (another $545)

OR

You can file an I-765 for EAD ($340) and hold until October (Just before a full medical would be needed) and file I-485 for AOS and hope it is approved after 2 years of marriage, AOS typically takes 4 months or longer to process.

$340 for an EAD is less than the hassle of filing and paying $545 for I-751 to remove conditions, you can also simply not apply fro EAD until October if you don't intend on working.

my hubby said that he didnt continue on applying for I-130 coz we have been approved on I-129??..do we need to apply again or dont need to???..thanks
No, You are adjusting from a K-3 visa, all you need to attach is a copy of I-130 NOA 2 (Approval) letter to the I-485 to base the AOS on an approved I-130, the I-485 will have "A" Checked.
