Visiting US while CR1 being processed

my sister got married in august 2008 in Canada. her husband has a visitor visa to US that is valid for 5 years. He does not have canadian citizenship but is a resident of Canada. He got hte visa in like jan 2008 or so. He has visited US in aug 2008 and dec 2008. He now wants to apply for immigration visa (aka CR1). i have the following question:

can he come to the US to visit while the immigraiton visa is being processed or will they deny him entry even though he has a visitor's visa.

He will be allowed to visit during the process but it is always up to the CBP officer at the port of entry whether they allow him in or not. Make sure he carries a copy of the NOA and/or a copy of the CR-1 petition/application and other proof that he will return to Canada. Even though it specifies K-1 visas, this is a good link for visiting do's and don'ts: Visitation FAQ's

Yeah, having a B2 doesnt gaurantee you can cross. Its upto the officer at the POE to feel satisfied that the non USC isnt going to immigrate

Where's his passport from?

He may have to show strong ties to Canada or his home country and depending on his home country, it may be a hard sell. If he were a Canadian Citizen I'd say it would be a lot easier. My husband has been coming into the US every other weekend (at least) for the past couple of years, over 1 of those years with a CR-1 in progress. But he's a Canadian citizen.

yeah he is not a citizen of canada but just has a canadian resident card, so he might face some issue. i apprecaite everyones input.
