hey guys,

i had filed for a k1 visa sept. 2007, it was approved last april 2008. due to family problems, mostly on my side, we decided that i should move back to the philippines and not continue with the petition. we're planning on getting married here instead since we have more family here...meaning i'll need to file a spouse visa to bring him back to the states...

...i really hate being away from him, (and im sure u guys know what im talking about..? so im wondering which path to take, K1 or K3??

Until you get married your only option is the K1 which is for Fiances, When you get married you have 2 options, the K3 or the IR/CR1. If you check out the guides the differences are discussed although in most cases the IR/CR1 is just slightly longer to get than the K3 but the IR/CR1 is cheaper to get and the spouse is able to work as soon as they get the US which has certain advantages.

If you marry, K1 is not longer an option as you'll no longer have a fiance. You'll need to file for a spouse visa. CR1 is the wise choice. Start by carefully studying the appropriate Guide here on VJ. Your first step once you're certain you'll marry in the PI, is to withdraw your previous I-129F petition.
