Divorce almost final (Hearing on feb 9 2009)

I got married on 01/20/2006 in texas,filed AOS in june 2007 got approved for conditional green card in september of 2007, meant to remove condition in june 2009( 90 days window).Married someone i thought we really loved each other, known each other for over 12-15 yrs , she is the u.s.c and i am beneficiary.We have a 2yr old son. I the beneficiary (Male), confronted her about the guy calling her everyday, late night, early morning ( November) with wife over her secretly receiving calls from some high school friend of hers( met on face book), she hasn't even seen the guy for good 15 yrs, she moved out of the house said she needs her space and continued her love calls with the other guy she met on face book, guy is in Gambia.She is travelling to Gambia to see the guy next day after divorce hearing, son will be with me while she is with the guy in gambia, She filed for divorce 5 days after she moved out, said she doesn't love me any more.Arizona waiting period is 60 days for divorce. We both share custody of son. I am really shocked and can't believe what i am going through.Anyways divorce almost final ( hearing feb.9th) . I have gathered all docs :

1. Lease Agreement - (2005 - 2008)

2. Auto Insurance/ Health Insurance cards, declaration page ( 2006-2008)

3. Utility Bills ( Gas,Direct tv,Electric bill- 2007- 2008)

4. Childs birth certificate

5. Pictures. Airline tickets for 3 of us

6. Her school loan stmts showing our last name and me as contact

7. I.R.S transcripts showing both our names

8. Auto purchase with both our names on contract ( 2006-2007)

9. Will have divorce decree by feb. 9th.

I will appreciate any other suggestions that can help.

So sorry to hear about this, must be very difficult for your son as well as you.

If you are still on good terms, you might ask her for an affidavit that the marriage was entered in good faith, that you loved each other etc. I only say this, because if she intends to bring another husband and do AOS etc for him, I doubt she will have any inclination to help you after remarriage.

Also your list didn't have joint bank statements, if you have those, that could be useful also.

Thanks. We still in good terms. Does she have to help. With affidavit? Just to mention I came to u.s.a. on. Student visa in 2002. She didn't bring me here. Right now she has no job.no car ( repo) , got almost 6k in school loan and that's what she is using to travel and survive for now. Rent assistance she got for jan, from community assistance.

As soon as the dicorce is final file the I-751. There's a good chance you will have a interview.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You should be all set. You must have worked enough hours to sponcer yourself. Ok i am not sure exactly what it is called, but look up on the application. You have to have worked so many hours or something. Good luck!

I really appreciate all that has dropped me notes concerning my situation. I will be mailing out my application next day after divorce hearing and will keep u guys posted. I asked that she write an affidavit for me which she did. I will be submitting that too.
