Hello again all!

OK, peeps already informed me i dont need to apply for a K-1 visa as im already in the states on a visitors visa, so I can apply straight for the AOS.

Now I think what we have decided to do is get married in a court and get the certificate and then file for the AOS before Sept, which is when my visa runs out- but then have our actual 'wedding' (or renewal of vows)sometime next year. We just dont feel we can, or want to, rush all the plans and get my friends and family over from the UK, AND file for the AOS before Sept, plus a lot of people cant afford to come over here yet.

But im just wondering how that will be viewed in our application? Will they want to see photos from the court ceremony etc.?

Also, this is probably obvious, but it shouldnt be a problem getting my friends and family over here for the ceremony should it if I dont have my permanent residence through yet? I mean, techinally they are just coming to Vegas on holiday right? and my parents could be here for up to 3 months on the visa waiver right?Its just Ive seen a few other threads where people say their parents etc. cant get a visa to come here for weddings. Im a bit confuzzled. :wacko:

You will definitely have to have some pics from the courthouse ceremony. My husband and I did the courthouse thing while i was on the vwp and just had my MIL as a witness. Technically you don't have to have any witnesses and we plan a big wedding next year with all friends/family.

With regards to your friends and family coming over, the immigration officers won't care if its jack the rippers wedding they are coming for. They are just concerned with each individuals intent at the port of entry, but most people if they have a return ticket in hand will get very little questioning.

Your over-stay on the vwp will be automatically forgiven if you do wait until september to marry as you are marrying a USC. At our interview and most others I have heard of, they dont even question a short overstay on the vwp at the AOS interview. Just don't stay for years out of status and get married as soon as you conveniently can.

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

Try to get some photos from your courthouse wedding if you can... it does help.... when you file for AOS dont bother with the AP.... because you can on a VWP and are doing AOS it is not advisable to leave the States until you have your Greencard... for any reason.... as they may refuse you entry and it does change the staus that you were admitted into the States...

Ok...I am confused...I thought they frowned on people staying in the US after a VWP and getting married then filing for AOS?? I was told they put up a fuss and it takes FOREVER to get a greencard.

May: Received Notice about Greencard Expiration end of August

July 15: Sent packet in mail!! (FINALLY!!)

July 16: Packet arrives @ CSC 10:52am Signed by V. Semegi

July 24: Received NOA (posted 7/21)

July 30: Received Bio Appt Letter in Mail

August 20 @ 2pm: Biometrics Appt. –

Sept 12: Approved!! Should be getting card within 60 days..

April 22: Mailing N400 Citizenship packet to Phoenix AZ! (about time!)

April 25 10:37am Phoenix USCIS Lockbox. Signed for by F DOMINGUEZ

April 28 NOA (received in mail May 2)

June 7 Biometrics Appt

July 26 8:10am Interview/Test APPROVED!

Jul 26 Oath Ceremony! Pete is now a US Citizen!

BlueRain77 it only is a problem if you lied at entry and already had planned to marry and remain.... if you entered as a visitor and then deceided to get get married and remain then it is no problem and you can do AOS from within the States.... it took us 181 days to get my Greencard approval.....

the big problem is that if you entered on VWP then you have no right of appeal... so if you were denied you would have to go home and file for K3... and you can not leave the States under any circumstances until you have your Greencard....
