Probably any of those things can happen, Melissa, but I wouldn't panic. Even if the worst-case scenario comes to pass and Aidan's AOS is denied, the beauty of your having waited out the K-1 process is this: You have the right to appeal. So thank your lucky stars that you had the sense and patience to go through with the K-1.

If you do file an appeal, Aidan has permission to stay throughout the adjudication of the appeal, and you can argue your case directly before an immigration judge. So even if a denial happens (and honestly, from what you've told us here, I think you have a good chance of success), you're still not toast just yet.

From what I'm reading, I'm guessing you submitted your current employment info and what not with no letter attached?

My I-864 was a complete package separate from the AOS package. On the front of it was a 1 and 1/2 page letter that explained IN DETAIL my financial situation - which wasn't pretty.

I had to submit when 3 years taxes were required. All three years were with my ex husband. My past income, when sorted out from his, was FAR less than the poverty level - and I was having to hit it for 3 people, not two. My present income was adequate, but only with child support included.

There were other factors also - but my point is that I put a cover letter on it. I plead my case. If you didn't explain your situation, do it. The person looking over your petition probably didn't want to be bothered trying to put the puzzle pieces together.
