Timeline

Hi,

Perhaps this is a silly question, but I'll give it a try... We have our AOS interview on March 2nd, and our 2-year wedding anniversary date is on October. If the GC interview goes well I was wondering if it is possible to request a GC validity date of October, so that we avoid having to apply for removal of conditions. I'm currently on a H-1b visa (Allows dual-intent) and have no need to travel abroad until December or so...

If your case gets approved any time before your marriage second anniversary, you will have to remove condition. Which means even of you get approved one day from the 2 years mark, you wont get the 10 years GC.

No you can not ask the mighty USCIS to postponed the date of GC. If that was possible most people will ask for that

That's what I suspected. What If for example I intentionally didn't bring some documents for the interview, like police clearance, birth certificate, etc.. (or brought copies instead of originals)? Does anybody knows how soon they re-schedule you for a second interview?

They would not reschedule an interview, they would give you a RFE and you would need to mail in the requested documents. You have a very limited time frame to send in the documents or your case will be denided and removal procedings will be started. That would cost you more money than having to file for removal of conditions...

I just checked and for RFEs they give you a timeframe of 12 weeks to submit new evidence. In my case this is not enough time, but it might be an useful loophole for people who have their interviews scheduled within a 2-3 month timeframe before their 2-year anniversary.

I guess the only way I would get a 10-yr GC is if I got stuck in a FBI name check (I have a very common name)
