Hi,

I have some questions. My fiance and I first meet the first time she got a J-1 visa to come to the USA. My fiance is coming out to the USA again on a J-1 visa in April for work and travel and going back home in July. I want to know if I can start the K-1 visa process while she is here in the USA or do I have to do it before she comes out to the USA. I was thinking maybe start it in March and so when she leaves to go back hopefully the process for the K-1 visa will be done and she can come back around September or October. Also would there be any issues with the K-1 visa process if she already has a J-1 visa.

Any help would be much appreciated.

There's no rule that says you can't start the K1 process (I-129f petition) while the beneficiary is (still) inside the US. :thumbs:
