you will be saddled with huge medical bills and if they can't pay, they will come after you as the sponsor. When they die your responsibility as a sponsor goes away but that will not prevent next of kin or a widow or widower still being responsible for any outstanding medical bills directly from the hospital.

I have since been advised from several sources that this is NOT the case. The USCIS affidavit of financial sponsorship does not carry over to civil debts and any creditor attempting to use the I-864 as leverage will almost certainly fail in court. With regard to hospital bills, any debts remaining after the death of the patient will be taken out of their estate. If there are still remaining debts after the estate has been exhausted then the hospital will write the debt off as bad. Unless you have specifically completed a financial responsibility agreement with the hospital taking shared ownership of the patient's bills the debt will not pass on to you.

I would be interested if anyone has experience to the contrary.

the I-864 is a contract between the sponsor and the US Government... nobody else is a party to it.... The sponsor may be on the hook for any FEDERAL "means tested" benefits that the aliens receive....

However, some family court cases have evolved where the courts have tried to apply or use the I-864 to the detriment of the US sponsor... (Stump v Stump in Indiana and another case in Florida)....

You won't beable to get any traditional health insurance for your parents because of their age but there are some companies that provide a reasonably priced insurance for elderly immigrants. Its called elderly immigrant inbound insurance and whilst it won't cover pre existing conditions (no insurance will, at their ages) it will cover them for everything else for 5 years or until they have their US citizenship and then they can purchase medicare, I say purchase because they will have to pay for it but its affordable and WILL cover pre existing conditions then, they don't get it at the same price as a US citizen who has paid in all their lives which is only fair of course.

This is not the case you can get insurance for people over 65 who are immigrating to the USA and they will cover pre-existing conditions as long as you can show they have been covered under a helth care plan. The NHS medical card is all that is needed to prove they were covered under the NHS health care system until the day they left the UK.

A Private Health Insurance plan for both my parents will cost $1054 per month and covers my fathers Diabetes and my Mothers underactive thyroid. As for them keeping a home in the UK just incase they need to go back for treatment will not work. They have to be registed with a doctor in their area and you will need to inform The Department of Pensions that they have left the UK or they will be claiming benefits they are not entitled too as well as paying tax when they do not need to. Their House in the UK will mean they have to pay council tax.

I would have a lawyer look into what you are recomending to make sure your parents will not be getting themselves into trouble by not being truthful about their residency status in the UK.

TayRivers, are you parents over 65? And if so, do you mind me asking who the insurance provider is?

Timeline

My Mother is 67 and my Father is 72, They will be insured from their arrival date with Fallon Communitiy Health Plan. They will have a deductable of $2000 and Co-pays of $20 for PCP and $30 for Specialist. They will have RX coverage at 10/20/40 and there is no annual limit. Hospital coverage is at 100% once deductable has been met.
