A little confused

Hey,

Im just looking for some quick explainations of what happens and what to do once my husband gets here.

Im assuming apply for adjustment of status once he gets here.. but then what?? Is it true he cant get a job for almost 3 months?? And cant get a drivers license until he gets the approval to work? Does he have to wait to get a ssn to get a drivers license?? Im so confused. I thought it was much easier!!!!!!!!!

Any thoughts would be appreciated!

Once your husband arrives he should wait about 2 weeks and then he should apply for his social security card at your local office.

regarding drivers lisences it varys from state to state. In illinois I was allowed to apply for my drivers lisence any time before my I-94 expired. I just needed proof of an address in the state. best bet is to check with your states DMV office to find out the rules and regulations ragarding that.

If he enters via JFK then he may get issued the temp work permit at the airport. its good for the duration ofhis K-1 but he'll need a social security card before he can accept any work. in addition, once the temp permit expires, in theory he's supposed to leave any employment until his EAD proper is issued. The EAD can take anywehere from a few weeks to a few months to be approved (just look at my timeline !!). Without an EAD your hubby cannot work in the US.

K1 and K3 are different. As a K3, he will not be able to apply for a SSN without an EAD.

Hey Amy,

Driving license-wise, all you need to get one is a social security number, but as the above person said, in your case he will need to have his EAD, which takes 45-90 days (if I remember correctly.) As far as I am aware, and depending on the law of your home state, if your husband already drives he may initially be able to drive using the license of his home country, but only for a certain period of time. Check with your home state's Dept. of Motor Vehicles on that - and if anyone knows differently please correct me on that.

Not sure if this will help you but my lawyer told me that K3 visa holders can go to the local immigration office to get an EAD in one day. I guess you can book an appointment online using INFOPASS. This is what I plan to do once I am in the states.

Maybe you should ask your lawyer when the last instance of that happening was.

I follow this sort of thing and have not seen anyone get a locally issued EAD since the Chicago lockbox filings started.

I'd hate to see you count on something that can't happen.

I asked this of the Secretary of States office in Illinois the same question about the drivers license. This is what he required:

- Social Security Number (Meaning the letter from the office is good enough, not meaning exactly the SS card)

- Proof of Address (Just have a relative from a family member mail your spouse a letter with his / her name as the addressee)

- Proof of Signature (Passport, credit card)

And after that is the driver's test!!
