Haven't been on VJ for a while now... and I know that I'm kind of pushing all this to the last minute but right after we got to the States my company (FoMoCo) relocated me (us) from KC MO to Det MI. What a mess that was. Didn't get married b/4 we left KC then didn't have an address until we closed on the house so here we are.

Right, so we got married this past Monday (Dec 8th). Her K1 expires on the 19th. We went to the SS office yesterday (Friday the 12th) only to be told that they can't process the name change because we are within 14 days of her going out of status. We are told to file AOS and then come back when we have documentation of her new status.

Our Visa Journey

07/29/07 ---- Mailed I-129F

08/25/07 --- Check finally cashed (8/27 I should be able to see the R number on the back).

08/27/07 --- NOA1 Arrives from CSC and I create my account profile on the USCIS.Gov web-site (the clock starts)!!!

02/05/08 --- After 191 days NOA2 (Approval) comes at last!!!!

2/14/08 --- NVC sends letter saying that it's on the way to the US Embassy in Bangkok

2/25/08 --- She receives Packet 3 from the Embassy

3/29/08 --- She receives Packet 4 with interview date (July 11th).

3/30/08 --- I e-mail the Embassy asking to make the date earlier because I've already got our tickets for June 13th!!!

5/6/08 --- No help from the Embassy. Rebooked tickets and vacation till September.

5/21/08 --- Embassy calls her and moves interview to May 27th!!!!! You have got to be kidding me!!!

9/21/08 --- POE San Francisco!!!!

12/8/08 --- Married!!!!

12/15/08 --- Mail AOS + AP + EAD package to Chicago

12/28/08 --- Come back from vacation and find AOS/AP/EAD NOA 1 and Bio App notices in the mailbox!!!

1/13/09 --- Bio Appt

4/22/09 --- AOS Interview "APPROVED"!!!

3/04/2011 --- OUR BABY IS BORN... We have a son!!!!!

3/10/2011 --- Mail I-751 application to lift conditions on residency

3/12/2011 --- I-751 Package received by CSC

3/14/2011 --- NOA 1

3/21/2011 --- NOA 2 (Biometrics Appt 4/18/2011)

5/27/2011 --- ROC Approved. 10 Year Green Card arrived 6/04/2011

Yep, this is correct, SSA will not issue or do anything within the 2 weeks or so before I-94 expiration, no matter, I would hold on changing it until after getting green-card, so that you can d 2 things at the same time, change name and get notation removed from the SSN card.

File for AOS, and EAD using married name, and on G-325A, put maiden name under Other names USed, and on I-485 put maiden name on the line that asks for Name on I-94.

Is now a US Citizen immigration completed Jan 12, 2012.

Got it... thanks. Are they really serious about the photo needing to show the right ear? What's wrong with a simple passport shot?

08/27/07 --- NOA1 Arrives from CSC and I create my account profile on the USCIS.Gov web-site (the clock starts)!!!

02/05/08 --- After 191 days NOA2 (Approval) comes at last!!!!

2/14/08 --- NVC sends letter saying that it's on the way to the US Embassy in Bangkok

2/25/08 --- She receives Packet 3 from the Embassy

3/29/08 --- She receives Packet 4 with interview date (July 11th).

3/30/08 --- I e-mail the Embassy asking to make the date earlier because I've already got our tickets for June 13th!!!

5/6/08 --- No help from the Embassy. Rebooked tickets and vacation till September.

5/21/08 --- Embassy calls her and moves interview to May 27th!!!!! You have got to be kidding me!!!

9/21/08 --- POE San Francisco!!!!

12/8/08 --- Married!!!!

It's no wonder people in the US "to postal"!!!

On the USCIS forms download page there is no instruciton form for EAD only the I-765 and it has not built in instructions. When you search USCIS for "765" you find the following link "http://www.uscis.gov/propub/DocView/afmid/dat/I_765.PDF" to a form that expired in '05

The form on the download page "http://www.uscis.gov/files/form/I-765.pdf" expired 8/31/08 (I assume it's still good). But, again, has no instructions despite what block 16 says:

16. Go to Part 2 of the Instructions, Eligibility Categories. In the space below,

place the letter and number of the category you selected from the instructions

(For example, (a)(8), ©(17)(iii), etc.).

I was looking for instructions 'casue I wanted to know what C 9 was all about in the example form on VJ.

Boy am I ever glad I can read English... I mean really - 4 pages to tell you what address to send your 765 to?

K-1 always check (C )(9 ) based on the pending I-485, if you base the I-765 on the K-1 you will pay and wast $340 because the EAD based on K-1 expires the same date as I-94 card, in your case the application will be invalid before USCIS would even start processing it.

YOU SEND the I-765 to the same address as I-485 Chicago PO Box, in fact it should be in the same envelope as the I-485 for adjustment of status.
