Hello! I have some questions, my friend needs help.

She's a US Citizen and her husband is an H1B visa holder.

What does she needs to do to petition her husband?

Does she need to file I-130? and the husband the i485 adjustment of status?

Any information will be greatly appreciated.


Dec. 01, 2005 - Applied I-130 PR

Dec. 08, 2005 - Received NOA1

Sep. 28, 2008 - Called CSC to upgrade I-130 TO IR1

Oct. 08, 2008 - Received a letter from CSC

Oct. 17, 2008 - I-130 petition approved (online)

Oct. 22, 2008 - NOA2 received by mail

Oct. 29, 2008 - DS3032 and AOS generated

Oct. 30, 2008 - DS3032 sent to NVC via email

Nov. 01, 2008 - Receive DS3032 and AOS Bill by mail - DS3032 sent to NVC by mail

Nov. 01, 2008 - Paid AOS online

Nov. 04, 2008 - DS3032 received by NVC

Nov. 04, 2008 - Paid IV Bill online

Nov. 05, 2008 - AOS Document Sent to NVC Overnight

Nov. 12, 2008 - DS230 Documents sent to NVC Overnight

Dec. 08, 2008 - CASE COMPLETE

Feb. 18, 2008 - Medical - PASSED

Feb. 25, 2009 – INTERVIEW – MANILA - PASSED "Thank you Lord"

Apr. 03, 2009 - Finally United after 6 years.

Apr. 15, 2009 - SS card received.

I'm in the same situation..don't forget to do a medical with a civil surgeon and make sure your shots are up to date etc, and TB, HIV and Syph testing and include that with your packet. If the H1B status is going to be ok for a while you probably won't need AP as you can travel on your current visa, or EAD as you're already working. If they're running out like mine will be shortly put in for the EAD at least.

24th January 2012 Received conformation e-mail from USCIS

25th January 2012 Cheque cashed

13th February 2012 Biometrics appointment

5th March 2012 Received e-mail I am in line for interview scheduling

8th March 2012 Received letter for interview

12th April 2012 Interview date-approved

10th May 2012 Oath ceremony

yes

I'm in the same situation..don't forget to do a medical with a civil surgeon and make sure your shots are up to date etc, and TB, HIV and Syph testing and include that with your packet. So i told her to do I-130 concurrent with i485 then it requires affidavit of support for i485 then i765.

Should she need to submit all this applications all at the same time. Attached to each other.

Also, it says something about biometric, do they need to wait for an appointment for that? and the medical? do they need to wait for an appointment for that too after she mailed all the application forms?

I apologize for more questions, we just wanted to make sure that she will do it right. They cant afford an attorney, so I'm hoping I or we can help her.

Yes, she needs to file the I-130 (includes G325-A) and I-485 (which also includes the I-864 and yes the medical exam from civil surgeon), make sure to follow all the information provided on "Step-by-Step Guide on How to File for Adjustment of Status"

The Biometric exam (take a photo and 10 fingerprints) is to be done afterward. The USCIS will send you a letter to inform the date and place to go for the exam.

Ask your friend to start to prepare early, since everything takes time, like to get a certified copy of marriage certificate, or take 1 week for the medical exam result, and copies of all kinds of documents.........etc.

Specially the applicant is on H1B visa, I would also suggest to file the EAD (I-765) and AP (I-131), since it is free and you never know if you need them. Coz I saw cases before that , the person with H1B visa got laid-off and couldnt find a job, so the H1B visa expire and he couldnt do anything. Well....just to suggest, hope these might help!!
