Emotions aside, there is no reason to pursue K1? As the foreign fiance will not be allowed to enter US? Ive read the links posted above... but im wondering if theres ever a case where they allowed a waiver.

If indeed there was a such case, the fact remains the same - you still have HIV and it is incurable and you have to deal with it - K1 or no K1.

True but can they still pursue K1 or not?

To qualify to apply for an HIV waiver, an applicant must be:

* The spouse of a U.S. citizen or legal permanent resident; or

* The unmarried son or daughter of a U.S. citizen or legal permanent resident; or

* The minor, unmarried lawfully adopted child of a U.S. citizen; or

* The parent of a son or daughter who is a U.S. citizen or legal permanent resident; or

* Eligible to self-petition under the Violence against Women Act (i.e. the abused spouse of a U.S. citizen or legal permanent resident); or

* A Refugee or Asylee who falls under a “humanitarian” exception to the HIV bar

I plan to come to the U.S. as the fiancé or fiancee of a U.S. citizen. How can I get an HIV waiver if I won’t have a qualifying relative until I get to the U.S. and marry?

The consulate has the authority to grant conditional approval of an HIV waiver if all of the requirements other than the qualifying relative are met and you can establish that you would be eligible once you marry the U.S. citizen petitioner.

Only those with qualifying relative. Its still up to the consulate for K1 aaplicants.

I dont think pursuing k 1 is posible...one must have to be a USC spouse...

First, I want to say thank you to all those who responded. Well, i don't know yet if i am positive or negative. But I am sure I am negative. I just want to be sure also before doing the medical test. I know this is a sensitive issue. But as we all know HIV is widely spread in the Philippines now so when I saw it on the tv last week I got curious and wanted to be tested now so my anxiety will be alleviated rather than being so nervous at the SLEC while they are extracting my blood. Coz as we all know it's part of the test. Maybe you haven't seen any threads like mine here but I just want to know also if someone had a pre-screen test which is what I am planning to do now.

Dont be paranoid :). Its normal to be nervous. You can go get tested in a hospital actually to ease your mind.

Is there anyone here who test themselves first for HIV before having their medical exam at SLMEC? If you did? where did you have it here in the Philippines and how much? I want to be sure that i will be ok with my medical exam. Any help from my kababayan's is very much appreciated.

before HIV testing, mag pa ELISA test ka muna.Its only Php500.

Do you know any trusted place to have it? Nakakatakot daw kasi sa health center na ngtetest for free baka daw kasi instead na hindi ka infectious eh lalo pa ma-infect. Im just wondering if there's a home kit available in Pinas now?

I sincerely hope that you're just paranoid regarding the matter. And sorry, I don't know anyone who had a pre-screen test specifically for the USEM medical exam. But I must admit though that I had an HIV test earlier last year prior to my medical exam. Is that good enough for you? :)

Ive never heard of any home kit so i dont know about that. Id suggest just go to a private hospital or your family doctor.

If that's what's weighing on your mind "TAKOT" then you better ask you fiance to order an HIV kit online and they can deliver right on your doorstep ...Goodluck...

I sincerely hope that you're just paranoid regarding the matter. And sorry, I don't know anyone who had a pre-screen test specifically for the USEM medical exam. But I must admit though that I had an HIV test earlier last year prior to my medical exam. Is that good enough for you? :)

Go to the more known hospitals or clinics if that would ease your mind. Had my HIV test last year at an accredited clinic of Medicard. :)
