big problem and I need same help!

By imailin in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas

this is the deal: my brother in law is married with an american citizen (already for 7 yeras) and they never borried about his status. He came to this country 30 years ago and lost his I94. They just send a form to immigration requesting a copy of his I-94 (as a lawyer advised them) and they denied it saying that they were unable to find his I-94 and proove that he ever had one. With the requesting form they send a copy of his passport (with the stamp from the airport). What else they can do? I mean, he came through a airport (he has the stamp on his passport) how they can appeal this? They can not fill any form for adjustment of status because he does not know the I-94 number!!!! I need same help!!!!! what else they can do!!????? :unsure:

06/07/2007 Received NOA

09/20/2007 Went to get an stamp, denied stamp at the Miami USCIS Office =(

01/31/2008 Transfer to Vermont Service Center (after almost 8 months!)

02/22/2008 This case is now pending at the office to which it was transferred.

02/26/2008 This case is now pending at the office to which it was transferred. (Last Touched)

07/01/2008 : still waiting for a miracle after 390 days of suffering....

07/02/2008: Infopass Appointment. passport Stamp....

07/03/2008: Incredible!!!! Card Production Ordered!!!!!!

07/04/2008: Touched. Duplicate email Card Production Order

07/07/2008: Touched

07/08/2008: Touched. Email with notice of approval

07/09/2008: Touched again!

07/11/2008: CARD ARRIVES IN MAIL!!!!! THANKS!!!! WELLCOME IMMIGRANT LETTER!!! :P

he came in 30 years ago? his passport was stamped so that should be ok I think

if he cannot prove it, he might be tagged as Entered Without Inspection and that is a bad bad thing.

yes he came 30 years ago.... and he does have a passport with an stamp from immigration at the airport... but we do not know why immigration is not recognizing this......

If he proves that he got inspected on the airport with the stamp , he can fill AOS with no problem!!

I came on 2004 throuh LAX airport, and they didnt give me an I-94.. they just stamped my passport stating that I could stay here legally for 6 months

I actually just filled out AOS almost 3 weeks ago... and my lawyer just sent a copy of my mexican border crossing card (visa laser) ..

and when filling AOS... on form I-458 where it says I-94 number just put N/A

Exactly right priceless :thumbs:. The stamp in the passport should suffice.

Now, make sure he has a VALID passport that is effective for more than 1 year or so after visa issue expectancy (there are guidelines for this in the guides).

They will look at that application with a fine comb for such a long overstay. They might need a waiver so check out the waivers forum.
