Getting Turned Away at POE

I'm sure this is just a rumour but I just heard if you get turned away at POE, you're not allowed back in for 3/10 years... Is this really true? I'm supposed to be going for xmas but this is making me really worried! I have all the proof I'm coming back but still..... Anyone heard of this?

As far as I was concerned, you're just not allowed to use the VWP programme anymore for a certain amount of time. You're allowed to get a visa though obviously, so it shouldn't be worrying you.

If you are denied entry you forfit the right to travel under the VWP. Therefore you have to apply for a tourist visa.

You only get banned if you overstay. I think it's a three year ban if you overstay up to a year, and a 10 year ban if you overstay over a year.

You only lose the right to travel under whatever visa you were denied entry on, if it was VWP, then you would need a B1/B2 next time (but don't expect to get in on it).

My fiance was denied with a B1/B2 and she lost that visa. Anytime you are denied entry, you lose the visa you tried to enter on. Denial at POE as a vistor has no bearing on entering with a K visa, unless the person lied to be a visotor (used false documents for the B visa, or presented false documents to get in on VWP).

Yup, getting turned away does not affect the K-1.

Maybe Im a little confused...so why would a person coming to the US on a k1 visa be denied entry at the POE??

They were refering to the VWP not the K1, dont worry

listen mate... for one the all story about you having all the proof that you are coming back is pointless you are going on a VWP thats all so when you get to the port of entry and they ask you what's the reason for you visit................... YOU ARE JUST VISITING, TOURING OR SOMETHING dont go telling all your business the whole not being allowed to come back is a case by case thing RUSSELL BRAND got TURN BACK A FEW MONTHS AGO and well since being fired from BBC RADIO 2 well he flew to LA...

NO WORRIES just be cool and enjoy your stay i went to the state 3 times on VWP and i left it simple and short just visiting familly and friends and i am leaving on such and such date.

Some people DO get asked for evidence of returning, especially those that have circumstances different than yours. (more visits, longer stays, stated other reason for visiting..)

Russell Brand is a celebrity entertainer. He was denied because he had a criminal record, and obviously applied for a waiver or work visa that took another few months. Amy Winehouse was also denied entry to the US due to drug use and had to file for something similar.

Also, you will not be turned away at POE when using a K1 visa... try reading many other posts here and you'll find that being denied entry before on the VWP has no bearing on the K1.

The only precaution my American friend told me was "never to argue with immigration people."

The fiance is not from high fraud country. This story happened middle of 2008 (just this year)

Not an encouraging story but true...

You won't get a ban from being denied entry unless maybe physical or verbal abuse was involved or they suspected willful misrepresentation, or drugs etc were found.
