Does RFE on I-485 delay the other applications?

Hey All,

We had an RFE for additional tax info - I won't get into how it says we didn't need to submit this info and then asks for it cos I'm the gullible fool for believing that.

Anyway, the upshot of this means that it's been a two week lay off for us - we had to gather the info from my wife's mother.

As that RFE was for the I-485, will my EAD and Advance Parole to Travel carry on regardless and still be on time or should I add two weeks to that also?

Hi, The answer is no!. your EAD and AP are put on hold until you return the RFE. I know this from experience because we have had exactly the same thing

happen to us!. Unfortunately, all you can do now is wait until someone at the USCIS decides its time for them to look at your file.

Why so negative? Bad RFE experience? And I don't mean negative as such - I just mean the "Good Luck. I suspect you'll need it" bit?

Apart from this RFE we have had smooth sailing all the way. The EAD is the only thing we really need as if I don't start working soon I'll go nuts!!!

Everything is on hold! They have 30-60 days after they receive your RFE information to get back to you!

Im glad for you, your seas have been smooth all the way but remember, they now have 60 days in which to respond to you!. Do you really want to sit

at home for another 2 month's?. My hair was like a rock star when I started this process, I now look like Kojak! :crying:

Similar to Pablo, I also got a RFE. As long as you return the requested evidence promptly, your case processing will resume at the MSC, and the EAD and AP won't be delayed much. I received both on day 70 after filing, given the RFE in the middle. Take a look at my timeline for reference...

There are a few people here who have received their EAD/AP even after they received the RFE (and before they returned the missing docs), so it depends on the person handling your case I guess.

I think the 60 days is a time they give you to cover their butts so they won't have to field questions about the status of your case until that much time has passed. Although they can take that long to get back to processing, most often they won't. Much more likely, it will take a few days to a week after they get your RFE response to begin processing again.
