Hello! Need your help!!!

I’ve been charged with misdemeanor shop lifting while in the US. My case was dismissed, nole, no contribution. A month ago it was expunged.

I am married to American citizen and am applying for Alien Card right now.

Can this record be a reason of the denial of my petition?

Should I mention it on my paper work since it’s been expunged?

You may not believe me, but I was totally not guilty for that incident. My friend was shoplifting and I just happened to be there with him. However there was no way to prove my innocence. And now I’m really worried that it might affect my future with someone I really love.

So please, if you have any information on this case, I will appreciate your help so much!

Yes it should be included and an explanation of the subsequent dismissal and being expunged as well. You MUST report any charges. If you do not, and they somehow find you, you may be required forfeit your permanent residency.

I would not be too concerned about this being some dark spot on your record that shall prohibit you staying in America. Be honest.

a total exp will not show up anywhere (no arrest no final disp. your name is taken off the case number etc, but a partial will still show arrest with a final out come of pled not guilty case dismissed (in Okla) anyway. So dont be fooled to think it is a total completely gone when it might not be, because this anyone could still see

Thannk you all so much!

In my expungement papers it's said that both police arrest report and fingerprint card were destroyed. May it still show up on my file in FBI?

Should i include my court documents in my first paperwork package or should i just bring it with me on the interview just in case.

klop, please fill in your timeline so we may have a better idea of where you are in the process.

It is unclear whether you are already in America now (on a K1 visa), or whether you married abroad. Additional information would help.

I'm already in America now. I got married while beeing on my J1 vise which is expired now. And i'm just getting my paper work together right now, i haven't sent anything yet.

Did you get a waiver for you J1?

You have to tell them but since you weren't convicted it won't be a problem.

Honestly, i'm not really sure what the waiver is)) But i talked to lawyer and he told me that since i got married while being on the legal status in USA, i should have no problems with that on the interview. And i got some friend who were in the same situation and they had no problems at all.

This record is the only thing i'm really worried about.

One of the questions on the I-485 is whether or not you got a waiver of your 2-year home residency requirement. You MUST get a waiver of it.
