Moving back to husband's country

Hello All!

I am not sure this is the correct place for this question but thought I would give it a try.

I got married in August and going through AOS now. My husband and I are now thinking about moving back to St Lucia. How hard would this be? I would want us to be able to travel back and forth easily. Do we need to wait until he has his 10 year greencard? Any advice would be appreciated!

Moving to a foreign country with intent to live permanently will revoke the green-card, you will then need to file for a new visa if intend to move back to the USA. Green-cards are for living in the USA, they are not a "Permanent" 10 year re-entry visa.

The only way to deal with this is to become a US Citizen, this way you will always be welcome to return as a CITIZEN of the USA.

Maintaining Permanent Residence You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.

You may be found to have abandoned your permanent resident status if you:

• Move to another country intending to live there permanently.

• Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

• Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

• Fail to file income tax returns while living outside of the US for any period.

• Declare yourself a “nonimmigrant” on your tax returns.

Irie, if you were living there, you would be eligible to file directly at the consulate for your husband - Although all the stuff you have already done is considered abandoned and you start from scratch.

Louis likes it here. Just thinking about stuff. We would all be happier in the Caribbean I think. We will rethink it again after he gets citizenship. :-)

Hi there!!

Unfortunately, he would need to apply for citizenship in order to not have to go through the Visa process again. While I don't blame him for wanting to move back... St Lucia is beautiful

Yes, that is the easy part. I lived there for 6 months when I met my husband and was going to stay longer - I have that part all figured out. :-)
