Timeline

Hello everybody

We are getting ready to start filling out all the forms required from USCIS to start with my husbands petition?

On the I-485, one of the requirements for my husband is to have a valid I-94 card.

I asked him and he said that hes got like 3 of em in the past. They're all expired.. He said the last one he remembers was back in 2006 but he doesn't have em anymore.

Does he really needs to get a new I-94 to AOS?

Do you mean he has lost the I-94's or just has expired ones? The I-94 is what proves that he entered the US legally, which is a requirement to AOS. However, it can be expired - we only filed 5 months after the date on mine expired, as we had to save up the money. What kind of visa did he enter on?

Removing conditions:

10/9/10 - Package sent to Vermont

10/13/10 - NOA1 date, received 10/18

Without a valid I-94 it will be very difficult to prove he entered the country legally...

He needs an I-94 from his last entry - you cannot use the one from 2005 if he has been leaving and returning since then. I think you do need a new one, as it is the proof that he entered legally and is therefore eligible to AOS.

Hes been in the US since 2005... never left after that

Hmmm, if he has been here since '95 then I don't see how he can have had more I-94's, since you get them when you enter the country. He will need to prove he entered with inspection.

N-400 Journey

June 9th 2012 - Application sent

June 14th 2012 - NOA sent

June 28th - Biometrics letter sent -- July 26th Appointment date

July 12th 2012 - Early Biometrics/Walk-in

August ( ) - Interview letter received -- September 14th Interview date

September 14th 2012 - Interview! Oath date in hand, September 20th @ noon!
