HELLO I NEED A LITTLE HELP, MY WIFE GOT HER K 1 VISA ON APRIL 29 2008, AND WE CROSS THE BORDER THAT DAY, WE MARRIED ON MAY 17, THE I 94 SAYS IT EXPIRES ON JULY 29, WHICH PASSED ALREADY, WE HAVEN'T FILE FOR AOS BECAUSE MONEY, HER PASSPORT SAYS THE VISA WILL EXPIRE OCTOBER 29, I'M SENDING THE PAPER WORK TOMORROW THE 27TH, IS THERE GONNA BE A PROBLEM, HOW LONG CAN WE WAIT TO FILE AOS AFTER GETTING MARRIED?

Not a problem, many have to file AOS long after I-94 expire becouse of many reasons, the MARRIAGE needs to happen within the 90 days.

NOTE: Visa expiration is the last date to enter the USA, it has nothing to do with AOS process, the visa is VOIDED the moment is is used.

FIrst of all congraulations on your K1 visa and getting married. Like said before if you were married within 90 days you will be fine. They could ask you why you waited to file but that is all from what I have read. My wife and I just filed for the AOS and we did just in time before the I94 expired. That was a a great wait lifted. Our thoughts our with and we look forward to your update. Dont worry the hardest part is over ! YOU ARE TOGETHER with your wife ! How awsome is that ! Good Luck Chuck and Teresa

i know couples filed aos after 2 years or more, as long as they got married within 90 days. but many advises to file as soon as possible to aviod some problems.
