Just too let everyone know my wife's oath ceremony went fine. Yesterday. She is DONE!!!!

Congratulations.

You're from CZ, do you have any information about how smooth the US embassy in Prague is treating fiancee visas?

I cannot really comment on fiancee Visas. My wife and I have been married for 11 years and we got married in Prague. So she got her green immigration paperwork done before we even left. Sorry I could not be of any help.

oldahmed check this website below for April 12 naturalization ceremony for over 200 new Americans will preceede the concert at the Lincoln Memorial

http://www.abrahamlincoln200.org/calendar/...es-4-12-09.aspx

I surfed around the net and found that a member called manty posted a website about April 12 naturalization ceremony " i think this is the special ceremony that IO told you about oldahmed" Also i based it on the information below froma the member called manty which i believe this info is correct :

The following email might be useful - I was forwarded it by a friend:

"The Washington District Office advises that for at least the next several weeks it will be reducing the number of daily N-400 naturalization oath ceremonies conducted at USCIS Fairfax in anticipation of special ceremonies involving larger groups to be held at the Lincoln Memorial on April 12, and at the new Capitol Visitor Center on an as yet unspecified date. Regular daily ceremonies will continue to be conducted from time to time, although beneficiaries of approved N-400 applications may not be provided a date and time for their oath ceremony upon completion of their interview. USCIS Fairfax will continue to provide same-day oath ceremonies in special circumstances where N-400 applicants demonstrate reasonable need, and will be flexible in consideration of these cases. They will also continue to perform same day administrative ceremonies for Sec. 319(cool.gif cases, where the applicant resides abroad."

This information was posted by "thea" special oath ceremony each year at Mount Vernon. This year's ceremony is on 18 May 2009. (Thank you thea)

http://www.mountvernon.org/calendar/index....vent/calID/139/

This information was posted by "manty" It's for the Lincoln Bicentennial celebration on the 12th of April. They are evidently conducting a naturalization ceremony for over 200 new Americans that day.

http://www.abrahamlincoln200.org/calendar/...es-4-12-09.aspx

I guess this looks like a waiting game on who will get (to be chosen first) the oath letter. i just don't get it if USCIS have planned these special oath ceremony dates then why can't they send the oath letters to the people who got approved weeks ago?

Or these dates might be not true because they could be change anytime a friend told me.

Hi all,

Well, it's officially over! I had my oath ceremony today. It was at a court house, and there were 60 people at that ceremony getting naturalized. We were told to arrive at 12:30, the ceremony started at 1:30, and took one hour. Family and friends were allowed into the courtroom and sat towards the back. They gave people lots of opportunities to take pictures, both during the ceremony and afterward with the judge.

I want to wish everyone here the best of luck with whatever remains of your journey. I have found this site to be very helpful and I am glad that such a resource exists for those of us going through the immigration process.

Thanks,

Dima

Congratulations! We had a roadblock today. The IO I guess took ill or something and someone else took over and denied the case because we had not provided evidence that we are scheduled to leave within 45 days. We told the interviewing officer that our flight was for March 29, however, and he didn't ask for proof. He said, all looks good, congrats, come back next week for the oath. But then someone else got the case and said, "where is the proof of travel," but they never called or did a request for evidence. Just denied and now we are paying $605 and filing an N-336 for a hearing. I have already put together my response. It seems pretty up front. The law says we have to show that we are leaving the country within 45 days of naturalization to qualify for 319b. Our flight, March 29, is 45 days after the interview, and clearly less than 45 after naturalization, given the fact that naturalization hasn't even happened yet!

I am delivering the request for hearing on Monday morning and will let you guys know how it goes. It is a very unexpected and frustrating turn of events. And I hope they can get it fixed before we have to leave the country.

How weird, no? They say, "You don't qualify b/c you aren't leaving the country soon enough," and our response is, "Dude, if you don't hurry up there is no way we will even be able to get passport in time we are leaving so soon."

From what the other 319b people say, this is a clear case of an officer not fully understanding a pretty obscure section of Immigration law. This is costing us $605 but hopefully it will be reversed. I mean we are really kind of freaking out, but somewhat hopeful.

We were denied expedited naturalization under 319b based on my employment abroad. We have not yet decided whether we will file at appeal ($605 and many months), or just file a new application ($595 and many months).

We went to the District Office and they explained that we are right...we have all the evidence we need to qualify. But they said that they cannot reverse a decision based on new information. They can only base it on the information in the file at the time of denial. The officer who denied our application told us at the interview that my wife had passed and that no further information was needed. We are devastated. Spoke with a lawyer and he thought a new application would be faster than an appeal via N-336. He also recommended that we try to get the Congressman's office to pull some strings.

Seems ridiculous that they wouldn't consider new evidence on the spot. We are leaving to return abroad in 20 days. So devastated.

Lessons: Don't believe the IO when you take the test and they say, Congratulations. Give him all the evidence you think is necessary to pass. He might die. Or he might get sick or be transferred. Then another IO will have to decide your case just using the paperwork in the file. Perhaps this is obvious to most people but it wasn't to us.

Trying to keep our chins up. Your support has been very helpful.
