HELP!!

I don't know what to do. My husbands I-94 expires on Wednesday October 15th and we still don't have the vaccination part of the I693 part two done yet and the certified copy of our marriage certificate still hasn't arrived in the mail yet. I don't know what to do. Should I just send the I-485 package without this information and just expect an RFE instead of letting his I-94 expire. I know we won't be able to get the marriage certificate and vaccinations part done before Wednesday and then send it all in. I am so nervous....Anyone have any advice for us? He entered on a K1 visa on July 15th.....and we are now married.....

As long as you've gotten married within the 90-days (before the I-94 expired); which you did, you're fine. You can file your AOS as soon as you have your documents together. No need to worry.

Oh yes... Congratulations! (F)

THIS IS A FAQ.

You need to marry within the 90 days, YOU DO NOT need to file I-485 within the 90 days, many file well outside the 90 days because of many reasons, like (Waiting for copy of marriage cert, Vaccination record, don't have the $1010 required, waiting to file a tax return, so that can include the return with I-864, etc...)

I guess I was confused a little bit because on teh I-485 check list....one of the items says

6. Copy of the non US Citizen Spouses valid I-94 (front and back copies) ....and I understood valid as being not expired....

Does valid just mean that he actually was given one upon entering the country and that it doesn't matter if it is expired or not?

Correct, it is valid because it is the actual one issued, but it can expire before filing the I-485.
