Traveling while filing joint petition I-751 Form

Hi,

I have to file the joint petition, Form I-751 between the 10/03/-8 and 01/03/09. I am traveling to Germany from the 11/03/08 until 12/03/08. Can I send in the File before I leave or should I send it when I come back? Can I travel while the conditional basis of my card is getting removed?

Your conditional card is good for all purposes until it expires. Don't plan on the I-751 being completed before the old one expires. When the old card expires, the NOA will act as a 1 year extention of your old card

You can file before you leave, but you risk being out of the country when your biometrics appointment is scheduled. Most people who have filed recently are getting biometrics scheduled about a month after an application is received. If I were you, I'd file upon returning to the States.

You can certainly travel while the application is being processed, as long as you have either an unexpired green card or an expired green card plus NOA1 extending the expired card for a year.

Day 1: Application delivered to AZ

Timeline for Removing Conditions:

Green card received 117 days after application was delivered to USCIS

Timeline for AOS:

Green card received 120 days after application was delivered to USCIS
