I-94 not required for re-entry with AP document?

Hello All,

I just called up USCIS and I was transferred to an immigration officer and I was able to ask a few questions regarding AP.

My question was, is an I-94 required for re-entry with the AP document.

I was told by the officer that it is not required, because the I-485 AOS is pending.

I-94 is only issued for visas giving 30-90 days or up to 6 months for visitors.

Can anyone confirm this.

I'm not sure, but I thought I-94 was required anytime with a multiple entry temporary visa. My wife entered on a K-3 visa, which is good for two years, and they told us I-94 was required to re-enter. However, since she entered on a K-3 visa, she didn't have to apply for AP, so it might be different in your case.

You still fill out a new I-94 upon re-entry:

If the CBP officer is satisfied that an individual is admissible on advance parole, the CBP officer must endorse the I-94 card with a parole stamp, indicate the basis of parole, the date the person is paroled, the date of action, the port of entry, and the CBP officer's stamp number. This information should also be placed in the action block on the advance parole and in the person's passport.
