Cheers and congrats first of all -

Keep in mind that once u file that K1 visa thats what she enters on - so you can NOT marry until she enters or gets the visa. Sorry reading quickly but I think you understand. You can not file the K3 after a K1 (I-129F) unless it lapses or withdrawn.

Yeah for sure. Now that brings up a question.....

If let's say May rolls around and the k1 visa is for some reason wrapped up in red tape, if I hit the 'withdrawal' button, is that an instant thing where I can get married in a month or 2 without complicating the k3 process that would start upon marraige??

I'm pretty confident about the k1 getting approved, as long as stuff doesn't get lost in the mail.

A couple of minor questions:

1) I'm in the process of selling my house, and I'm not sure what my next address will be. So on all the forms, my 'current address' will definitely change. Does that complicate anything?

2) I was a loan officer from 2003 to the middle of 2007, at which time I became a mortgage broker. When I made that switch, I went from being w2'd to 1099'd. So for 2007, half of my income shows on a w2, and the other half on a schedule C, with a bunch of deductions. I'm assuming that when I have to prove income, they go with the net profit on the schedule C, which won't be much. If I have to show assets, can I use a IRA rollover to prove them? If not & the income is questionable, who can I use as a co-sponsor? Immediate family or anyone who is willing?

Keep current addy on forms until it changes then there is a form you can submit to USCIS.

I am self employed, just watch that number on Scedule C - assets can be included also but x a certain percentage - co sponsor of course.

Now on throwing the switch, uggghhhh - you throw switch per se, if you can and then refile, you have just lost three to four months again.

I think your choice here is to decide to marry and go the IRI/CRI route and wait it out (which is not that much longer than an I129f anymore) and has more benefits to the visa or go with the I129F and bring her here on that visa. The threads can help you alot, just alot of reading and as some of my mates say, back to school. sigh

Move to Bali.

Sell all your assets in USA and start a new life over there.

Live like a King over there for a fraction of what it cost in the USA.

Live like a King over there for a fraction of what it cost in the USA.

You know, that's definitely been a consideration of mine. I've gone there 8 out of the last 10 summers & have a blast every time I go. One thing I've noticed though is that it keeps getting progressively more & more crowded. The surf breaks that used to be manageable are now a zoo!! At least if we live in the US, we do plan on going back to Indo for a month or 2 every year. And once we have children, we'll need to go back so we can visit the family & show off the kids. Tough life.

Another question, maybe Tinyrosie or anyone else can answer....

I've heard that in order to buy land in Indo, you have to buy it through an Indonesian citizen. So let's just say that we wanted to buy some land, how far into the marraige process would Syelvia lose that ability? After Marraige? After she gets a US Green Card??? If she loses the ability to buy land there quickly after we marry, then we may want to look into doing it sooner than later.

Hi Jordan,

Yes, it is true that foreign nationals can not own land in Indonesia. If you and your Indonesian wife purchase a property (house or land) in Indonesia, then as far as I know, your wife's name will be the only one written on the ownership certificate.

My sister is a credit analyst for a large bank in Indonesia. She gets to decide if one should be given a loan (for car,

house, land, business, etc). Anyways... she told me that it was very difficult for Indonesian citizen married to a foreign

national to get a loan to purchase a house or land because our law didn't specify what would happen to the property (and all the liabilities related to the property) if there was a divorce or if the Indonesian national died.

So banks usually decline to give a loan to an Indonesian citizen married to a foreign national.

You and your wife can have a property in Indonesia pretty easily if you purchase it by cash (not a loan from bank).

It's just that your name (foreign national spouse) will not be included in the ownership certificate, nor there is

an easy way for the foreign national spouse to have access to the property if there was a divorce or death of the

Indonesian spouse.

So I think it would be wise to discuss carefully with your (future) wife before purchasing a property in Indonesia.

1) You want an address that you know you will receive mail at... I am not sure you want to rely on the USPS mail forwarding service.

2) The look at the Total Income line of the Form 1040 (line 21 or 22 I think).

My understanding is that the prenup generally favors the non-citizen spouse, as property and property rights default to the citizen and citizen's family absent a written contract

My friend (an Indonesian) who got married with a foreigner made a prenuptial agreement so that way she won't lose her right from owning land in Indonesia. Anybody has ever heard about this?
