Received my RFE today and need some guidance

Hi VJ family. I'm posting here as i received an RFE from the USCIS National Benefits Center today. I had it in my mind that it would be just for the medical, I-693, which i chose not to include in my AOS as i wanted to get my application in before my I-94 on my VWP expired.

The RFE states 3 things.

1. In order to process your application further, submit evidence that the household member on Form I-864, Affidavit Of Suport, or Form I-864a (which my mother in law submitted) was authorized to work in the United States. Well, my mother-in-law is a US Citizen and was born here. Will a copy of her passport on the photo ID page be enough, or a copy of a birth certificate?

2. In order to process your application further, you need to submit a properly completed and signed I-693, Repotrt of Medical Examination and Vaccination Record for the applicant on form I-485. I have the medical I-693 sealed envelope with me... is this what i send off with the RFE to complete this one?

And lastly...

You have submitted Form I-693, Medical Examination of Aliens Seeking Adjustment Of Status, However, you failed to submit proper documentation of immunization for the Form I-485 Applicant. In order to process your application further, you need to submit a properly completed I-693 Report of Medical Examination and Vaccination Record. This one has completely thrown me off as i didn't submit any medical information, no I-693 what so ever. I picked it up from my Civil Surgeon the day after i sent off my AOS application. So i'm very confused :/

Would anyone please be able to clear up any of this for me?

06/20/2008 -- After the sad passing of my girlfriend's father, we decided to get married and stay together

08/08/2008 --- We get married, lovely ceremony and dinner with all of Sarah's family present :-)

08/25/2008 --- AOS package sent to Chicago via Fedex overnight priority mail. Fingers crossed now!

08/26/2008 -- AOS Package received in Chicago, signed for by A.Smith (1 day before my VWP expires!)

09/02/2008 -- Checks cashed!!

09/03/2008 -- NOA1 received for I-485, I-130 and I-765.

09/05/2008 -- Case is shown online as pending!!

09/08/2008 -- Biometrics appointment letter received for September 23rd!! (For both I-485 and I-765)

09/12/2008 -- Biometrics walk-in completed, 11 days before the appointment! In Hackensack NJ.

09/20/2008 -- RFE for I-485 received. It was dated September 17.

09/25/2008 -- RFE response evidence sent out to Lee's Summit by USPS, certified mail.

10/02/2008 -- RFE response evidence received and case processing resumed!

11/04/2008 -- EAD CARD PRODUCTION ORDERED! Thank you Lord.

11/10/2008 -- EAD card received in the mail! wOOt wOOt!!!!

11/12/2008 -- SSN ordered from Hackensack, 2-4 weeks in mail!

11/28/2008 -- SSN Received in the mail, wOOt!!!!!!!!

12/7/2008 -- INTERVIEW LETTER RECEIVED!!! It's scheduled February 19, 2009 at 8:30am in Newark. *nerves*

2/19/2009 -- Interview 8:30am - Green Card verbally approved

2/23/2009 -- Welcome letter received! followed by I-130 approval notice!

The I-864 co-sponsor should have proofs of her being a US citizen such as birth certificate and yes us passport. The I-693 must be inside the sealed envelop given by the Civil Surgeon and should be submitted together with the I-485 application. If you have DS_3025 (vaccination documentation worksheet) which was given to you at your home country where you had your medical exam done, should also be submitted with I-485. If you havent completed the vaccination schedule from your home country, then you need to complete it in here in the US even just the first dose of 3 (example HPV if 9-26 year of age) etc.

Easy!

Just send in proof of co sponsors USC and the I-693.

Hint!

You could have submited the AOS after your I-94 expired.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

3. My copy of my vaccination records from when i was a child, these are what i gave to the civil surgeon to work from. They are not photocopies, but they are photos my Mum (who is in England) took of the various papers and then sent them to me. (she didn't have access to a scanner at the time.) The civil surgeon thought that they were sufficient enough though.

Does this sound right? I was also going to attach a cover letter saying what is in the envelope and then send it via Fed Ex overnight.

For 1 and 2 yes thats right. FOr number 3 don't you have DS-3025 that was given to you when you had your medical in england? Don't forget to send them back the "original copy" of the Notice of RFE. :thumbs:

For 1 and 2 yes thats right. FOr number 3 don't you have DS-3025 that was given to you when you had your medical in england? Don't forget to send them back the "original copy" of the Notice of RFE. :thumbs:

No medical in England as the OP is adjusting from another visa from inside the US.

Hint!

You could have submited the AOS after your I-94 expired.

Hint! Adjusting from the VWP is different in some respects compared to adjusting from a visitor visa and very different compared to adjusting from a K1/K3. While overstaying a visitor visa is "forgiven" upon approval of PR based on marriage, a recent court case re: adjusting from VWP had the consequence of AOS-ing before expiration of I-94W a more cautious course of action, as the risk of being deported due to overstay is much higher.

Looks good. I would also include a copy of your mother-in-law's passport. As long as your medical also includes a list of your current immunizations (it should, check on your copy), then 3 shouldn't be needed (can't hurt either, so include if that gives you peace of mind).

Looks good. I would also include a copy of your mother-in-law's passport. As long as your medical also includes a list of your current immunizations (it should, check on your copy), then 3 shouldn't be needed (can't hurt either, so include if that gives you peace of mind).

1 is fine, 2 is fine. My mother in law doesn't have a passport though, she's never left the United States since birth! I'm pretty sure on the I-693 they ticked off the vaccinations i had as a kid from my copy, would this be the usual procedure?

Yes, the doctor probably used your vaccinations copy to transfer the info on the I-693. You should have received your own copy of the medical, so check on it.
