Good evening, Everbody,

A few quick questions:

When filling out the I-485, part 1 asks you to include your current USCIS Status. This would be K-1 Visa Holder, if you came in on a K1 visa, right?

And when it asks for an expiration date, are they asking when the visa expires as stamped in your passport?

Or are they asking when your three months expire, after your entry into the US?

Lastly, is the I-94 number, the number printed on top of the form? Kind of like a computerized serial number type thing?

Thanks for your help!!

And another stupid question:

If i fill out the I-485 form for my husband, who is the K1 holder, should i fill out part 5: "Signature of person preparing form, if other than above"?

Thanks again!

K-1 is the status

K-1 status expiration is indicated on the I-94

I-94 number is preprinted on the form

You certainly can indicate yourself as preparer, but they are most interested in if it is a third party preparer

YMMV

Thanks fwaguy,

So they aren't asking for the "visa" expiration date (which is 6 months from issue), they are asking for the K-1 expiration date, which is 90 from entry into US... correct?

Thanks,

hz

The visa expiration is meaningless. After entry you are granted K-1 status. For proper basis to adjust status, you must have married BEFORE K-1 status expired as indicated on the I-94. That is the critical date, and that is what they are asking for.

YMMV
