Hello all,

I am putting together our packet for AOS and submitting the I485, I131, and I765 all together.

Regarding the I765 document...

Question 15: Current Immigration Status

Do i just put K1 Visa, or do i put applying for AOS?

And then Question 16: Eligibility Categories

Are we an (a)(6) because my husband came on a fiance visa, and is my nonimmigrant spouse?

Or, are we an © (9) because we are adjusting status?

Thanks so much for your help!

If you are already in the US then you are filing for AOS since K1 visa is just a "permit" for your fiance to enter the US. Once entered in the US and marry then you are no longer classifed as a K1.
