I applied for the I-130 for my husband but was denied because our marriage is not considered valid since my husband's divorce was not complete at the time of our marriage. We are Muslim so we married in an Islamic court in the UAE and it was legal there. So now we have to remarry legally here again so we are going to apply for a fiance visa for him. My question is mainly about income. I am going to have my parents sponsor him and their income in more than enough. I just got back from living in India and well my income is nothing at the moment and I'm getting government benefits. Should I get off the benefits before I apply for the visa? I don't want to do anything to get him denied again because I'm tired of dealing with this. I'm trying to do everything right this time. Is it a bad idea if I'm on housing or is it better if I stay in my parent's home since they are sponsoring? Just any tips you can give me would be great. Also I was wondering since we have 1 son together is there a way to get a visa this way? He is the parent of a US citizen so I would think there should be something in that. Thanks.

You do not need give up your benefits to apply. You send in your papers and your parents theirs as cosponsors.

Your child cannot petition his had until he -kid- is 21 years old; BUT it does show a bona fide relationship.

The US Citizen is not applying for anything. You file a petition, which if approved, gives the beneficiary the privilege of applying for a visa. The child will help show a bona fide relationship but otherwise no impact or special consideration is available to the parent of a USC, over the relationship between spouse or fiance(e).
