Filing I-130 for stepkids while husband's I-130 is still processing?

Hello,

We just realized that to bring my husband's kids to the U.S. we need to file individual I-130s for them. My husband has a lifetime bar with a waiver available after 10 years (which will be up in August 2009). In the I-130 process for hubby, we have received NOA1 and a transfer notice to local office for interview, so I am waiting to receive notice of interview appointment for me at the local office.

MY QUESTION is, if we file I-130s for the kids now, will they

1. process faster than hubby's I-130 and be allowed in before him?

2. get put together with hubby's I-130 and process together?

3. something else?

I don't know the answer to your question but I would certainly get the kids' petitions submitted now so that there may be a chance they can connect them. If the waiver is only availabel August 2009, wouldn't you need to wait until then anyway?

CR-1/IR-1 Journey for Self

12th April 08 - Married in Australia

21st April 08 - Mailed off I-130 but with incorrect title on cheques

30th April 08 - USCIS returned petitions requesting correct title on cheques

2nd May 08 - Mailed out I-130s again! Finally on our way!!!

9th May 08 - NOA-1

7th Nov 08 - Tranferred to CSC

4th Dec 08 - Approved!!!

22nd Dec 08 - NVC # assigned

23rd June 09 - Case Complete at NVC (We slowed down the process on purpose to time interview accordingly)

18th August 09 - Medical

25th August 09 - Interview Date - Approved!!!

19th February 10 - POE L.A (No dramas, just SLOW)

2nd March 10 - Welcome to America Letter
