priority date and expedite request.

hi

i got NOA-1,S for both i 130 and i 129 petitions.

i do not have a priority date mentioned on them.( is it quite usual to not have priority date mentioned on both NOA1,S)

i have two questions.

1] can i file an expedite for the application for extreme hardship as my wife has to live along with our baby alone in u.sa as we are having tough time to find a baby sitter .

2] whats the process to file an expedite.

do we just call the uscis directly and make a request or

do we have to contact our senator or congress person.

i think it is a little too early for me to think about expedite because its been a month since we received our NO1s and we filed our 130 on july 25th 2008, i just want to be prepared ahead in case we need to file one.

please help me with replies.

You call USCIS directlly at the 1-800 number listed on their website. Follow the instructions to get to a life representative and let them know you want to expedite your case. They review it for about a week and they return your call (only if the expedition has been approved) Just to let you know they are very strict about the reason of why you are requesting the expedition. Like I have mentioned before I am due to give birth any day and have no much support here in the states from anyone and they declined my request to expedite my case to bring my husband. Call them and try it. Best of luck!

Like the previous poster said you are going to have to call USCIS directly by their 1 800 number and go through the button pushing to get a live operator and explain your case and request for expedite. They will give you further information of a "case manager" that will work with you and review your situation to determine if they believe you qualify for an expedite.

I've only see 2 expedites based around pregnancy that were granted and both were due to medical conditions, one medical condition of the baby and another of the mother... And in both of those cases the USCIS required written information from the treating doctors and in one did a telephone conference with the doctors to verify the information that the USC presented to them.

It's very rare they will grant an expedite solely based on a normal healthy pregnancy just so that the USC and beneficiary can be together. But hey anything and everything is worth a try and no harm in calling! Good luck to you and I wish you a happy healthy Momma and baby! :thumbs:
