hi, I saw the other topics people started about the outdated version of I-765, but still I didn't get the answers that I needed. If there is anyone who got a rejection notice and resend it successfully your advice would be highly appreciated.

1)Question 11. Have you evere applied for EAD before? what's the right answer? I was thinking NO but who knows.

2)Besides NOA for I-485 as a proof of payment what other documents do you submit? any photos or ID proof that I submitted originally?

PLEASE PLEASE who knows answer, it's important

File it on-line then you know it is the correct form. you can find the e-file link at the USCIS website. save on mailing costs too.

Why would you think the answer is no? It doesn't ask if you have ever been approved before, it asks if you have ever applied before, which you have.

Not all situations allow for on-line filing, and I don't think that an initial EAD (as opposed to a renewal) for an adjustment applicant can be done through e-filing.

Send in everything you sent in last time, plus a copy of your previous rejection letter, and a copy of your NOA1 for the I-485.

I don't understand why question 11 is causing you much of an issue.

The question asks if you have ever applied before, and you have so say yes. What about that is confusing you?

For the new application, send the same things you sent the last time (on the correct form) and this time include a copy of your NOA1 for the I-485, and a copy of the rejection notice for the previous I-765.

Thank you so much. I was hoping I don't have to submit the photos and passport copies again, because they have them, but I guess that's what it takes.

You sent them in originally and they rejected the case. They won't keep the evidence of the case after that point. They don't know if and when you'll file again. It's a new application, and the instructions tell you to send in passport copies and photos. If you left anything out because "it was in the last application I sent in" then you'll get an RFE for missing information.
