For those adjusting on the VWP...

Richard -

Every case is different. "Comparing notes" might be consoling but at the end of the day your case will be evaluated on its own merit.

No one here can give you anything more than anecdotal evidence. Predictions aren't possible.

I wasn't asking to predict, or to compare notes. I was looking for ideas for home ties to the UK and to discuss them. I understand every case is individual, thank you very much.

-Richard

Your original post in this thread mentions nothing of home ties or evidencing same. Re-read it if you are unsure of what you originally asked about.

Normally I have no problem with VWP adjusters. But your prior postings are evidence enough for me that you and your wife elected to marry and for you to stay in the US because it was inconvenient for you to wait out a K1 visa in your home country.

I'm sure your relationship is genuine and not intended to fraud the US for immigration purposes. But your methods are less than stellar and you trip yourself up in your written commentary. If you are struggling to put your evidence together, perhaps that is why.

As much as i appreciate your "smart" comments my main reasons for adjusting on the VWP is not due to a K-1 visa not being appropriate to wait out for in the UK, it is due to a death in the family of my now Wife, her father in fact. If you want to go talking about original posts here is mine: http://www.visapro.com/message-board/showthread.php?t=20043

Perhaps before you make obvious criticisms you should do your research first.

The post you are referring to was an innocent question, as i was very new to these boards then if you look at the date. My girlfriend (now my wife) and i at the time were considering a K-1 petition yes, for 2009 or 2010, but decided to have the summer holiday first eventually. There was no death in the families back then, there is no plot to thicken. These are discussion boards and i dont appreciate being somewhat ridiculed by you.

I'm sooo confused now.

So when you entered the US did you have a K-1 application in the system?

No I did not, rebecca is trying to pick things up which aren't there. I never have applied for any visa in my life and when i entered the US in May of 2008 at the POE there was absolutely no intention of marriage or immigration in anyway, and that's all there is to it. Whether in the future my girlfriend and I briefly discussed about applying one day for a K-1 visa and finding out what one is is irrelevant.

I am not ridiculing you. I am reading from your original posts and, in those posts it is clear your fiance was at least considering sending in the K1 petition before you arrived in the US this spring, and not in 2009 or 2010. Unless of course you were referring to a visit in 2009/2010 in those posts.

My question is, if you have a K-1 visa in the process, all be it if the petition has been submitted, with or without approval, or if you have returned the forms from your home country and are waiting to be invitied for an interview, and you visit the usa to take care of your fiance's father who is really sick and help around the home using the Visa Waiver Programme, can the immigration officer see this at the port of entry, that you have an application processing, without you submitting the information? If you said visiting a friend would he be able to tell that it was a straight lie from his screen or something?

Kind Regards,

Rich

In all due respect this isn't ridicule at all. It is a series of queries that are not at all out of line. It might be the sort of questioning that *could* ensue at an AOS interview. So you should be prepared. Oh, and by the way, urban legend or otherwise, these fora are not off limits for AOs eyes. :)

Richard, if you are struggling now with the questions asked on an open forum by strangers how on earth are you going to cope at your AOS interview? The questions that have been put to here might also be put to you at your interivew - will you answer in the same manner?

Richard,

Dealing with Immigration stuff is in itself stressful - don't let people on here get you even more worried! You will have your interview, you'll tell the truth and that's all there is to it! I'm sure there are very many cases like yours and adjusting from VWP definitely is not a big deal. You'll be fine - don't stress out at this point!
