SSN card issue

I am wondering if someone can enlighten me.

We applied for my husband's SSN card on June 20, 2008 and at that time were told that we should have the card in about 4 weeks. Those four weeks came and went and we both began to call the office to see what was going on, but received little response (ie. they did not answer and did not respond to our messages). Yesterday, we received a letter stating that my husband would not be granted a social security number because "Your legal immigration status and/or documents will expire before an SSN card can be issued to you". At that time we realized that his I-94 expired on August 13.

Do you think that we have a case to go fight this with Social Security office? Is there any way to tell them that we gave them ample time to process the card (8-9 weeks) and that we should not be punished for their incompetencies?

If that won't work, can we reapply wiht EAD or do we have to wait for AOS?

Why they didn't issue the card/number initially is a mystery but fighting the SSA will likely fall on deaf ears. Once you have EAD can reapply. :thumbs:

When an alien requests an SSN or replacement card, SSA must verify his or her documents/current status with the appropriate Bureau of the Department of Homeland Security.

The Social Security Administration has no jurisdiction over immigration laws, procedures or the workload of Bureaus of the Department of Homeland Security.

SSA will not assign an SSN or issue a card to an individual that is within 14 days of his or her alien status expiring.

The 14 day status expiration limit for assigning an SSN and/or issuing a card applies even if an individual submitted his or her application before being within the 14 day period and entered the 14 day period while waiting for his or her status to be verified.

If his K-1 status is expired or will expire within 14 days, he will need to provide an EAD card or I-551 stamp or card.
