So I've gotten an RFE for my I-485.

-It says I needed my Notice of Action from my I-129F (OK that's ok I'll just send them my photocopy...)

-It also says that I needed another Notice of Action from I-130. I NEVER filled a petition for alien relative... is that a big problem then? Or they just needed my NAC for I-129F?

-They wanted my birth certificate. I SWEAR I gave them my photocopy of birth certificate. Did they wanted my original one? I triple checked to see if I included a copy of my birth certificate and it was THERE. What's up with that? I guess I'm not in a position to argue because they still absolutely want one.

Thanks for your help... :star: I'm feeling a bit pissed off :( I hate this immigration process, I wish it could have been easier for everybody. And their "hotline" sucks.

4/07 - Filed the I-129 F [Petition for Alien Fiancé(e)] Along with Bio forms [G-325a for both of us]

6/07 - Forms got resent back to my Fiance because I forgot to sign some papers. [silly me]

11/28/07 - Got my K1-Packet 3!!! It was a headache to fill in the papers.

2/15/08 - Sent all documents and forms through express! I was close to the expiration date

3/27/08 - Interview letter!!! I was in the US with my Fiance so I couldn't come back in time, rescheduled appointment.

4/24/08 - Got my interview done :) Approved! Passport+visa+brown envelope will be sent within a week.

5/1/08 - Got my Visa!

~ Flying to US on 6/11/08.

~June 19 2008- Married!!!

7/25/08 - Sent in AOS: I-485 along with EAD, AP.

8/7/08 - EAD, AP, AOS touched.

8/19/08 - Got an RFE for I-485... Fixing it.

8/22/08 - Biometrics taken in Portland.

10/08 - Another Bio (for work authorization card).

-- received my work authorization card and advance parole papers in meantime--

1/15/09 - AOS INTERVIEW *faints* in Seattle, Washington.

2/2/09 - Green Card!

I'd include a brief paragraph when returning the info they've requested from the RFE. Include your photocopy of the NOA2 from the 129F, mark that as item #1, then state you came in on a K-1, so therefore don't have an I-130. I can't remember off hand if they want a certified copy of the BC or not. I think they just require a copy of the BC, and then if you have an interview, you would bring the certified copy, but see specifically what they're asking for. Many times they ask for things we're sure of sending. I think things get lost sometimes. Given tons of people have their medicals lost and have to pay hundred's of dollars to get another one, then I'd say you were pretty lucky!

Send what they want asap so that your process is not interrupted for too long. Best of luck!

Non-english birth certificates must be translated into English. I know you're from Canada, so that probably doesn't apply.

Also, they often lose things, so you may just need to send another copy of the one you already sent.

I wonder how things get lost when all your papers are sent in one mail :mellow:

I am going to resend my NOA for I-129F, but how do I know if its the NOA1 or NOA2? I only received one NOA... And it starts with something like "The above petition has been approved. etc etc"

I will also include a little letter explaining my situation, thanks for the heads up Carla :D

Concerning my birth certificate, I'm actually from Quebec (French) and luckily I requested an English version of the certificate a few years ago heh, so no problems with that. USCIS prolly just lost it, gosh!

I also have an appointment for the biometrics on this Friday... I hope I won't be refused just because I got an RFE for my I-485 and my case got "paused".

I could have just called the service center to ask all these questions but their number was busy, I called their number countless times today. =( Not surprised.

The Notice of Action that says approved is your NOA2. That's the one you copy and send.

Getting an RFE for things you've already sent is a common thing around here. I know it's frustrating, but you really don't have a choice but to send them again. Who knows HOW they get lost...it's one of those unsolved mysteries. ;)

The Notice of Action that says approved is your NOA2. That's the one you copy and send.

Getting an RFE for things you've already sent is a common thing around here. I know it's frustrating, but you really don't have a choice but to send them again. Who knows HOW they get lost...it's one of those unsolved mysteries. ;)

Haha yeah, maybe they have a dog around their offices walking around and "eating their homework"!

Since I have the NOA2, what is NOA1 then?
