I clicked on the link and saw a bunch of dates, the 1 130 was listed as Jan 2006? past due as in there's a date we have to submit by?

I'm sorry for all the questions but the more I learn, the more questions I have. Things aren't at all consistent so...

As always you should check the USCIS processing times to see if your application

is past due.

NOA #2: Approval June 25th, 2009 - 92 days

NVC

July 8, 2009 to August 10, 2009 - 28 days

Interview Assigned - December 3, 2009 - FINALLY!!

Medical - December 14, 2009 - Passed

Embassy/Interview - January 26, 2010 Montreal, Quebec Canada - 167 days PASSED!!!

Port of Entry - February 26, 2010 Baltimore International, Maryland

USCIS -- ROC package sent off

November 26, 2011 to Vermont station November 30, 2011 received NOA1December 16, 2011 received biometrics appointment.

January 04, 2012 Biometrics

September 2, 2012, RFE Received.

September 22, 2012 RFE responded to

October 15, 2012 ROC approved, 10 Green card on its way.

In checking the Vermont Service Center, I see the date as September, 2007. Does that mean that they're not processing any more applications?

How can one find out if a date is necessary or what/when it is?

And I see that the California Service center says January 17, 2008. So, just wondering what this all means.

Not sure exactly what you are looking for but...

There are different I-130s for different purposes. Spousal I-130s are the ones you are interested in. Both VSC and CSC have different dates. The dates they list are the dates they say they are working on presently.

So if you are past due, your receipt date would be older than the date they have listed. They usually want you to wait quite a while after you are past due before you complain.

And to answer your more specific question, they continue to accept petitions. They're just far behind.

In other words, VSC is currently working on applications filed in September 2007 and should be done with all those filed in August, July, June 2007 and before. So if somebody filed in July 2007 and still hasn't received a decision, they would want to contact USCIS to see what happened to their petition. Anyone who filed after September 2007 is supposed to just be waiting for their applications to get worked on.

Those dates supposedly mean that ALL files UP TO that date are complete.

Long story short, we have a complicated case. We've been at this for nearly 5 years. You can read our story here. I highly recommend our attorney Laurel Scott, as well as attorneys Laura Fernandez and Lizz Cannon .

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.
