Hey there, Just had a quick question. If two people are engaged and want to visit eachother for lengthy stays during the lengthy K-1 process is it okay?

I dont mean get married on the travel visa but just stay with eachother while the K-1 is processing. Would it hurt our chances of getting approved?

also would it then make us have to wait 6 months from the travel visa she used before she could actually use the K-1?

One last thing, Do many people get in trouble for marriage on travel visas? It doesnt seem like someone could, though it might not be the smartest thing to do i understand. what are the downsides?

From what I've read around the site, visiting your fiance in America for short times during the K-1 Visa process isn't breaking any rules but there's also some factors that you need to consider. You could be denied entry into the country at the airport should they be suspicious of your intentions and you are unable to provide proof that you will be returning to your home country (return ticket, apartment lease, letter from employer, etc). But it sounds like you want to use a travel visa to stay in America during the entire waiting period? I'm not too sure how well that would work since you have to do a lot of work in your own home country at the end of the process. Perhaps someone with more knowledge can give you better information about this.

I work in computers so it's not hard to work abroad. But it sounds like the process is very one sided so i dont see why it would be a problem to stay with eachother during the time in our countries ( other than its a bit spendy ). But perhaps i am missing something.

We havnt officially filed for any visa yet and i was hoping for her to visit my family and everyhting for christmas.

Are you the petitioner or the beneficiary? If you are the petitioner then yes you can definitely stay in your foreign fiance's country for as long as you want.

If you are the beneficiary, then getting a tourist visa to stay in america with your fiance depends upon many things. if you can provide strong ties to your home country, etc. I have heard of people being denied entry into the US while a K-1 is pending. It just depends on a number of things, luck included.

From what I understand, you can get married on a travel visa though that would be losing the point of applying for K1 because this is a fiance visa. You won't be able to use it afterwards. Therefore you would have to apply for a spouse visa instead.

Is your K1 already being processed? If so, it would be wise to stick with that one. You can visit your fiance and she can visit you, though make sure you have evidence of ties to your home country as others have said.

Hungary is part of the VWP so you can use that as long as you have nothing that prevents YOU peronally from doing so. You can visit up to 90 days. Whether you get in the Country or not is up to the POE officer. The burden is upon you to prove that you are not intending to immigrate. Judging by your last comment, that already seems to be on your mind...

If you enter on a visitor's visa, or even get denied entry (aka 'allowed to withdraw your petition for entry') it will have no effect on your K1 as long as there was no other issue. The K1 is valid for US entry up to 6 months after it is approved at the Consulate level. There are no time restrictions other than than that and none in relation to other visitors visas used.

While some people do enter the US on a visitor visa and marry it is unlawful and considered fraud if you enter the US with the intent of immigrating (again... something you have already mentioned ;) ). Do many people get in trouble? Well, I don't know what the statistics are but many who try to adjust status this way have to attend an interview at the AOS stage and again, the burden is upon you to prove you did not enter the Country with the intentions of immigrating. If it is proven you will face a ban to the United States for misrepresentation. Is it really worth the risk? ;)
