Technically if some one is a permanent resident at the end of a calendar year and has been in the US for at least one day in that year, she/he needs to file taxes for that year.

I don't know if it will be a big deal, or even if the two govt agencies talk to each other, but if it was me or my spouse, I wouldn't take the chance and I would file an amended return.

I don't know where to start because her income was not taxable. I do my own Taxes through TurboTax.

I also submitted only 1 tax return (not even the IRS transcript either) and got approved. I would say don't worry about it - in my experience, people here tend to be overly paranoid :)

I am definitely paranoid when it comes to dealing with govt agencies - especially the immigration and taxation agancies.

HB34, If you do decide to amend a return: http://www.irs.gov/taxtopics/tc308.html is a good place to start for information.

Again, you may want to check with a tax professional, but my understanding is that if your wife was a permanent resident for any part of the year her previously non-taxable income became taxable when she became a PR.

Timeline for Naturalization:

Day 1: Application delivered to AZ

Timeline for Removing Conditions:

Green card received 117 days after application was delivered to USCIS

Timeline for AOS:

Green card received 120 days after application was delivered to USCIS

I am preparing to file my wife's 751 in two weeks. We only have one joint return (2007). My wife did not file in 2006. Will this be a problem?

we didn't send in ANY tax returns and still got approved...

just depends on other evidence,...tax returns are just one.

However,...if you have a joint lease with both names and rent receipts, thats also a very strong form of evidence.

Dec 25th -She purposed and i said Yes!
May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview
Feb 26, 2009 -Oath.....the end.

Yes I have a thick packet of evidence. We have joint leases, utility bills, credit cards, bank accounts, installment loans. We also have pictures of us together all over the US and Europe (in front of famous landmarks).

I did not know her income became taxable :blink:
