"Claiming' on taxes for new job- Help!

Hi all,

I'm hoping you can help me. I just started a new job, and on my tax papers I claimed "1". When I had to check off my marital status, I checked "single", because it said to do so if you are married but your spouse is a "nonresident alien". Did I do this correctly?? I assumed that since my husband is obviously not a US citizen and the I-130 hasn't even been approved yet, that he is considered a "nonresident alien". My HR agreed, but now I'm wondering if I did something wrong.

What do you think?

I did the same... I am fully expecting to get money back though at the end of the year! :angry: They should know that this process isn't cheap and we should get the deduction but whatever....just one more irritating thing

I am not an accountant but yes... that are the rules... you can claim yourself and anychildren than head of household if you like but that's it.... when we get them over we can change our deductions anytime.

i don't think you can claim somebody that doesn't have a social.. i'm still filed single 'cuz he isn't here technically... you will be fine.. my brother still claims single, his wife is abroad, and he's been "single" for 2 years now

7/21 : NOA2 - APPROVED!!!

NVC Timeline:

7/25 : Case # assigned

9/30 : Case completed!!!! (THANK YOU, LORD!!!)

10/03: Interview date assigned

US Embassy in Manila:

10/30 : Paid Document Verification (just to be on the safe side)

11/12 - 11/13 : Medical at SLEC

11/18: INTERVIEW DATE/MANILA EMBASSY/0630AM - VISA APPROVED!

11/20 : Visa in hand! (that was fast!)

11/30 : Flight to USA!

Life in America:

11/30 : POE:LAX

12/04 : SSN issued - 12/13: card received in the mail

12/04 : "Green Card" issued - 12/13: card received in the mail

NOVEMBER 30, 2010 : CR1 expires

yeah.. and they have a 2 year old too! it's b'coz he still hasn't applied for citizenship.. crazy, eh? my husband will be here soon and his wife is still stuck over there!
