Hola all..If my fiance gets his fiance visa thru Mexico, he plans on going and spending a few weeks in Mexico before returning to the US. He plans on flying. Does he HAVE to go through JFK? How does that work? Thanks!!

Nope, his POE can be wherever he likes. But apparently, those who go through JFK get some sort of temporary work permit (which is unique to that airport by all accounts) which enables them to work immediately.

This is exactly why I will NOT be using JFK as my POE - so 'er indoors can support my lazy ####### for a few months! :lol:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

SO, He can work immediately even without a ss#? As long as he gets this work permitt thru JFK? SO if he were just crossing by land, he gets that same stamp at the bridge, right?

No, he needs a SSN. And it is hit or miss whether or not he will get the stamp through a land crossing. JFK is known as being the most consistent POE to give the stamp, everywhere else does not have that reputation.

There are several POE's that give the EAD stamp. JFK is just the most well known. Here's a current list...

As Cassie stated above, he will need ss# as well (it's how he'll pay taxes to our great government! :huh: ). Best to wait until about 2 weeks after entry. ;) You must keep in mind that even if he does get a job the EAD will expire after 90 days, probably before you file for AOS and receive his EAD, which means he'll be left with time in which is not authorized to work by the DHS. Each employer is different in what they require for employment but it's something you must consider before deciding to make JFK your POE.
