Hi everyone. Last night we received an e-mail at around 8:30 that our I-129f was approved and then sometime during the night our I-130 approval also came by e-mail. Now previously we had an RFE that we responded to immediately, and all along the only petition touched was our I-130. We never received an official "touch" to our I-129f until it was approved. Now to my question, cause I knew you guys would want the previous info!!! I can't find anything in the guides pertaining to what you do if they're both approved at the same time. We understand the difference between the two and all the parameters to both. What we don't understand is how you let the NVC know what you prefer to go with. For instance, if we prefer to go with the K-3 route, how do we make that choice? Do we have a choice? We just want the quickest route to be together.

You may or may not have a choice but your best bet at the moment is to do nothing at all. Both petitions may be forewarded to NVC, but it's also only the I-129F will. Regardless, the I-129F will proceed on without input from you. If both petittions are forwarded and you prefer the K3 route anyway, you may simply ignore correspondence from NVC regarding the I-130. Doing so will damn it's progress temporarily and applying for status adjustment after arrival on a K3, will switch its purpose to be in support of the status adjustment.

We stopped corresponding with NVC early in their process and never communicated again. If I had it to do over, I'd probably let them know of my family's K3 arrival and their intent to adjust status, but not doing so was no problem for us.

As long as working and a few hundred more in expenses along with a second and potentially third step in the immigration process are of less importance than reuniting a couple months earlier, go for it. Otherwise, I'd seriously consider pushing the I-130 through the system and hope it catches up to the K3 case. That way, the K3 interview becomes a CR1 interview and you skip AOS.

Thanks Pushbrk, but what i still don't understand is both were approved at once. Will they send the I-129F directly to the consulate? Do I have to call them and ask? I don't want to ignore anything if they are keeping both petitions together and waiting on me to answer their requests. For reasons of our own, we'd prefer the K-3 route at this time. From what I've been reading it seems as if the I-129F is moot because the I-130 is approved???? Originally the I-129 F was because the I-130s were taking so long. I'm just not sure what to do at this point? Do we wait for them to contact us???? Thanks

To pursue the K3, you do nothing at this point. I129F will be forwarded to NVC and then on to the Consulate.

Wait a couple of weeks, call NVC and give them the receipt number for your I129F, and they can tell you if they received it and forwarded it on to the embassy. If not repeat this every few days till you hear it went on to the embassy.
