Hello, I'm a US citizen, engaged to a british citizen. I'm in the process of filing for k1 fiance visa. My question is this. Her son will be added to application and both will be coming to live in states. What other documentation of forms do i need? What paperwork do i need if any from biological father?

How old is the child?

Were they married when she had the child? You need to determine whether he has "parental responsibility;" if he does then she will have to obtain a notorized affidavit from him giving his permission for her to move the child to the US. If he does not then you won't have to get this but you wil have to prove that he does not have parental responsibility.

If the biological father is on the birth certificate you will need a notarised letter from the father, if you are unable to get that or are no longer in contact with him you may have to get a order from the court giving you permission. They will ask you for evidence that you are able to take your child out of the country. Fortunately for me my Ex singed a letter and got it notarised for me cost £20 for the notarising.

I'm not sure that parental responsibility comes into play as that is a UK law and not a USA.
