Filing AOS while I-130 is pendng

Hi VJers!

I read other people`s posts on here and start thinking that I`m really unlucky one. My hubby filed I-130 on my behalf back in april and of cause it is not going to be touched for another 5 month for sure. We didn`t realize that we should file AOS together with it since I`m already here. The worst thing is we have never received a NOA1 for I-130. So we called in and been told that is was apparently lost in a mail or something and we cannot get a replacement one only receipt #. After reading this forums we got an idea that we can submit AOS while I-130 is pending so we called in again just to make sure and got a positeve answer from 2(!) reps. So we sent it and it got returned 2 weeks later because evidence of us filing I-130 wasnt there (what a lie!).

We resubmitted AOS packet 2 weeks ago with plenty of evidence that I-130 has been filed.... I smell another rejection notice... check hasen`t been cashed, no NOAs....

Has anyone been in a similar situation??? Is anything can be done here???

05/03/2008 call to USCIS because NOA1 not received ;( Got the receipt number and was told that we cannot get replacement NOA1.

08/21/2008 request for NOA1 for I-130 to file AOS placed over the phone and forwarded to VSC. Thanks to the first great Rep at USCIS hotline

10/17/2008 Hubby`s B-day, NOA1 for I-130 finally arrives!

10/21/2008 AOS sent to Chicago lockbox

10/31/2008 NOAs for AOS received

11/06/2008 I-130 is transferred to CSC

11/20/2008 biometrics done

12/02/2008 I-130 APPROVED!!!

01/02/2009 EAD received

02/12/2009 Interview APPROVED!!!

02/17/2009 welcome letter received

02/23/2009 GC received!!! yay!!!

11/18/2010 I-751 Sent to VSC

11/22/2010 NOA1

01/07/2011 Early Bio

01/27/2011 Scheduled Bio

05/11/2011 RC approved

05/17/2011 GC received

Naturalization

11/14/2011 Sent package via Priority to Nebraska SC

11/25/2011 NOA made it

Relocated to NE

04/03/2012 Interview passed!!!

04/10/2012 Oath

04/10/2012 New prints required/done

04/14/2012 Received a welcome packet but still no certificate

04/17/2012 Certificate is here!!!!! Dated 04/16/2012 huh????

I've read that it took some ppl 1 month b4 their check was cashed...I guess how soon you receive the NOA1 depends on where you live and what service center has your file...Good luck hope you get something soon (check cashed or NOA1)

Oct. 18........EAD in hand (came in mail)
Nov 3.........Interview Notice received in mail
Dec 4.........Interview APPROVED, CRIS email: card production ordered
Dec 9.........Welcome noticed received in mail Dec 9.........card production ordered
Dec 14.......Received greencard in mail
